On January 9, the group of U.S. security agencies intervening in the FCC review issued this final petition to adopt conditions agreed to by SunCom Wireless (TPC) / Deutsche Telekom AG (DT) and the agencies with respect to this transaction. This document essentially announces DHS, DOJ and FBI consent to the transaction without further action.
Naturally, this is an extremely positive development for the transaction and should effectively allow the FCC review to proceed at an normal pace from this point.
Today is day 92 on the informal review "timeclock" As of this entry there have been no comments received in the case other than that of the security agencies. The lack of third-party interest, combined with the quick consent of the DHS/DOJ/FBI, now suggest that this deal can (again) conceivably close before the second quarter of this year. If the FCC review continues to move forward without third-party interest, approval would not be terribly surprising well before the end of the 180-day target in mid April.
