Sirius, XM and C3SR...Who?
I'm sorry, I realize that this is old news but I just have to put my one cent thought in on this subject because I am literally sickened every time I see news about this company. "The Consumer Coalition For Competition In Satellite Radio". Are you serious? I mean really, are you kidding me? Yes, I have read the news articles about the NAB being linked to this company and how one person is linked to another office who's cousin's next door neighbor works for the NAB ...... blah blah blah. Forget all that for a second.
Is anyone with an IQ over three expected to believe that a group of "concerned citizens" actually formed a company, built a web site, and are paying $25,000 - $50,000 dollars per month in rent for an office in downtown Washington D.C. because they feel that strongly about a $12.00 radio subscription?
And on top of it they actually give it such an absurdly transparent name like "The Consumer Coalition For Competition In Satellite Radio".
Can someone on Capital Hill please tell me why they would allow a venture like this to waste tax payer time in a pitifully desperate attempt to delay the Sirius (SIRI)/XM (XMSR) merger decision even further? And are we to believe that no one in our justice system has seriously questioned or investigated the validity of this organization instead of blindly accepting it as legitimate? What is going on up there folks?
If the same energy, passion, and money that has gone into the temper tantrums displayed by the NAB and the politicians they hold in their pockets were channeled into fixing the collapse of our financial system, maybe we wouldn't have to watch the Dow Jones steer the ship closer to the iceberg on a daily basis.

By the way the only survey of satellite radio subscribers ever conducted was by a Canadian Research company NCR, they asked a total of 429 subscribers, when the two satellite radio companies had about 15 million subscribers. That's .0028% of all of us satellite radio consumers. There's a survey document that was submitted by C3SR to the FCC which lists a number of meaningless data point questions.

The Vicar has said before and will repeat: No vote in the foreseeable future. This is a big pocket veto occurring, and you all continue to deny the obvious. Why prolong the agony? There are so many better opportunities for your money.
If you had researched these companies and their regulators thoroughly instead of treating the market as a casino or sporting event, you would all be more successful investors.

After reading an article on Sirius Buzz, reported by Tyler Savery, outlining concerns of Stifel Nicolaus' analyst Blair Levin, and how hard Tate has been lobbied by NAB, Ibiquity and all the other Special Interests looking to block or steal a piece of the pie. It would be hard for her not to pen into the agreement some details that represent these interests into the merger agreement. The following are some possibilities:
1. At this point I don't see any way Tate will not vote with her Republican Partners and the DOJ for the merger.
2. She will impose penalties and fines for non compliance to provide "Unfettered Open Access" in a year for manufacturing of inter-operable radios. HD chip installation issues will be removed by guarantees by the companies for "open access" and Ibequity told to let the "market" decide whether they are included in devices or not.
3. I think, looking at spectrum compression technology down the road (or already here), she will not go along with "minority channels leased spectrum" being limited to 24 channels or to have the set aside defined by current "channel" spectrum efficiencies (Bandwidth per channel). Rather, the set aside will be defined by the current 24 channel bandwidth with channels increasing as bandwidth utilization technology improves. This will eliminate the calls for increase % of total spectrum / channels based on current technology compression and have minority channels increase with improvements in technology. A bit technical but, it does give a future increase in total channel set aside with improvements in compression technology. This could be the more significant of the concessions. While it doesn't give up more spectrum than is currently proposed, it does keep the merged company from shrinking the spectrum as technology improves, while still giving the 24 channels.
4. I think Tate realizes the value of #3 above and will restrict, to the advantage of the merged company, who can own and administrate the set aside spectrum. This has not been discussed much but, Tate is very active in advocating for children and womens' issues. I do not feel that Georgetown Partners has veiled their minority status near enough to escape her scrutiny. I don't know how this modification to set aside will be written in, but I do believe it will prevent minority ownership from profiteering by reselling the spectrum and assure that her advocacy groups will be represented in this set aside.
I know that this is just speculation, but Adelstein might even find these kind of concessions hard to vote against along with the others already agreed too by the parties. I just feel that in voting for the merger, regardless of party, the issues raised by Georgetown, Ibiquity, Public Knowledge, and others have to somehow be addressed even if they go against their expectation. It's either now on the Record, or in court as to why they weren't addressed by the "Commission" after giving up so much time to their presentations.

I never have a problem with people wanting to discus the negitives in SIRI/XMSR. What I have a problem with is when people do what that guy, you were talking about does, as I explaned.
cos1000, As to 3. I believe that that is already part of the agreement that as the compression increases so will the channels give up to minority concerns. I think if anything, she will reqiure a certain portion of the 8% will have to be given to women. I also think the only way Adelstein votes yes on this is if there are already 3 votes for it. He if anything is waiting on Tate to see what she does, if he votes for it. If it gos that way no one should take away from that, that he was always a yes vote. There are only 2 reasons he has not voted yet. 1. That he wants to push this back as long as possible. 2. He wants to see which way the wind is blowing. Think about it, the democrats have taken almost no heat about this delay. If they want to keep it that way they will ether vote for or against it right after Tate. Then they are still in the clear. Even if they vote against, most democrats are dumb enough not to realize that and still blame the republicans for a delay. I know that seems crazy, but look, who is getting blamed now after Martin voted for it. They cant blame Martin (even though some idiots still do). They move onto Tate. I would like to know how did Adelstein and Copps get lost in the blame are they not still on the fence, where is there vote. These are the same dumb a$$es that are voting for Obama (sorry had to through that in)
Ronjsq, I like most. I do have a problem with Pfizer and Merck, I just feel with TEVA and alike out there it is getting to hard to make that much on a drug in the years between when it is developed, and the patent runs out for all the money put into them. I like TEVA more then PFE. They get the benefit of all of PFE research at almost no cost. As long as Iran doesn't blow them up I think TEVA is the better of the 2. LOL
Regarding the Republican Commissioner attacks, speaking for my self who votes Republican, I am very disappointed that they allowed the process to be drawn out for such a long time after the DOJ vote. There is no excuse for their hesitance when the DOJ provided them with a perfect out. They showed themselves as weak in the face of NAB funded, Democratic opposition to the deal. That speaks volumes to the criticism from Republicans towards Martin, McDowell, and Tate because they have been in a position to approve of the merge and they failed to expedite the matter to get the deal done..
On the other hand, Democrats, will always blame Republicans, no matter what, for failed policy. I do not believe anyone ever put any stock in the Democratic Commissioners voting for this deal given their historic relationship with NAB. They were and still are the opposition to the merger. Even if Adelstein votes yes, he was never going to be the swing vote for the deal and Copps was never going to be for the deal, period. I believe as justified as criticizing them would be, it wouldn't make a difference in the outcome.
The Republican Commissioners' lack of solidarity in moving the vote forward earlier opened themselves up to the criticism that I, as much as I hate to say it, believe from Republicans, they justly deserve. No decision has been a decision that has cost the Companies and Investors millions of dollars to this point. They have been more afraid of their future jobs than in providing timely decision making in their present ones. NOT ONE of them spoke up during the process regarding the BS from Georgetown or C3SR, nor did they have their Republican Senators voice much in the way of support or discovery regarding these shams.
I agree that the merger will go through, but the pain provided was not necessary.

Here's my letter to Mrs. Tate:
Dear Mrs. Tate,
The recent advent of free streaming internet radio combined with
the recently approved Clear Channel merger has created an anti-
competitive bias against satellite radio providers. Although the
terrestrial radio companies have invested much to buy support, I
beseech you to resist the well paid opposition and approve the
Sirius / XM merger without any further conditions. The truth is that
satellite radio will have to fight hard to survive now; any further
delay may cripple their ability to remain solvent. I'm sure you are
concerned about the political implications of not cooperating with the
democratic pundits, however if you truly have future political
ambitions I would suggest that the public (myself included) is
watching your decision closely. The delay that the FCC has imposed on
this merger has already sacrificed billions of republican
constituent’s equity, this will not be lost from memory when your
political ambitions change from appointment offices to more publicly
controlled offices. If the power of the people is valuable to your
long term prospects, then I suggest you resist the short term benefit
gleaned by appeasing special interest groups, and do the right thing
here. Enough is enough. Please demonstrate your ability to be a fair
and offer your vote for merger approval. Thank you.
As to shure46 I told him he was over matched trying to debate me on this stuff, not because I was more intelligent then him, but because he was coming from the liberal side and liberals close their eyes and ears to anything they dont want to see or hear.
Dear Ms. Tate,
I respectfully request that you vote to approve the merger between Sirius Satillite Radio and XM Satillite Radio without further delay, concessions, or operational restrictions. Some politicians, like John Kerry, have requested that the combined company give up half the spectrum. This would be a rediculous requirement and the FCC should ignore any future statements from congressmen who make such requests, as they have no credibility. It's like requiring that Texaco and Chevron abandon half their oil fields, refineries, and gas stations in order to merge. Or like demanding that BellSouth and AT&T give up half their network and households to merge. Did anyone demand anything like that for those or any other large company mergers? Of course not. The spectrum is the company and it's future. These requests are a ploy to block the merger because these congressmen do not have the nerve to just say they are against the merger for political interests and leave it at that. These are the same people that advocate homosexual marriage as good for the USA. Demands like these must be ignored by the FCC.
