I'm sorry, I realize that this is old news but I just have to put my one cent thought in on this subject because I am literally sickened every time I see news about this company. "The Consumer Coalition For Competition In Satellite Radio". Are you serious? I mean really, are you kidding me? Yes, I have read the news articles about the NAB being linked to this company and how one person is linked to another office who's cousin's next door neighbor works for the NAB ...... blah blah blah. Forget all that for a second.

Is anyone with an IQ over three expected to believe that a group of "concerned citizens" actually formed a company, built a web site, and are paying $25,000 - $50,000 dollars per month in rent for an office in downtown Washington D.C. because they feel that strongly about a $12.00 radio subscription?

And on top of it they actually give it such an absurdly transparent name like "The Consumer Coalition For Competition In Satellite Radio".

Can someone on Capital Hill please tell me why they would allow a venture like this to waste tax payer time in a pitifully desperate attempt to delay the Sirius (SIRI)/XM (XMSR) merger decision even further? And are we to believe that no one in our justice system has seriously questioned or investigated the validity of this organization instead of blindly accepting it as legitimate? What is going on up there folks?

If the same energy, passion, and money that has gone into the temper tantrums displayed by the NAB and the politicians they hold in their pockets were channeled into fixing the collapse of our financial system, maybe we wouldn't have to watch the Dow Jones steer the ship closer to the iceberg on a daily basis.

    We all are sickened, too.
Martin needs to call the vote and get the vote recorded and over with...
    Enough is enough!!!
Signed Sirius subscriber and XM shareholder.

This just gets more unbelievably crazy as the weeks, months and now years go by. I guess Martin only has one boss and thats the President who doesn't have time for this.

They may have a few members who are XMSR employees afraid of loosing their jobs because of the merger. That may be why they conceal their identities. Otherwise, wouldn't they want people to know who they are if they felt so strongly about it?

Just a little more info on C3SR. "On January 12,2007, a group of law students at George Washington University in Washington, D.C. launched a new consumer advocacy group dedicated to ensuring continued competition in the digital satellite radio industry. The Consumer Coalition for Competition in Satellite Radio (C3SR), a student-run organization created on behalf of the 13 million satellite radio subscribers, has been spawned in response to rumors about the potential merger of XM and Sirius Satellite Radio." That's right from C3SR's website link.

By the way the only survey of satellite radio subscribers ever conducted was by a Canadian Research company NCR, they asked a total of 429 subscribers, when the two satellite radio companies had about 15 million subscribers. That's .0028% of all of us satellite radio consumers. There's a survey document that was submitted by C3SR to the FCC which lists a number of meaningless data point questions.

    correction.....Canadia... Research company is ..."NGR"

    Jul 11 09:18 AM
Even more absurd is that this "consumer group" was petitioning the FCC to revoke both companies licenses, effectively killing them. How is the destruction of satellite radio in the consumer's best interest? Perhaps it is in the NAB's best interest, but not mine.

This entire regulatory process has turned into a sick joke. We are seeing either corrupt or incompetent government. Maybe both.

C3SR is an opaque organization by any reasonable metric. That doesn't change the fact that the upside for the stocks of these cash-burning, money-losing, unprofitable companies is limited.

cos1000, I just thought you left out the most important thing about that survey. Which was that the biggest question that one would think they would have asked was not. That question was; Are you for, or are you against the merger. If they cared about the subscriber, would they not want to know how most of us feel about the biggest thing that C3SR is fighting against.

Martin is the biggest wuss on the planet. CALL THE QUESTION!! Now he is inviting the comissioners and the NAB to tie this up forever. What other conditions? 30-40% of spectrum to channels that no one will listen to? Stupid.
  •
    Jul 11 01:53 PM
163888..... Thank you for bringing that into the forefront. It was back at the end of May when we last discussed this sham of an advocacy group, I truly had dismissed them back then, but here we are again.
  •
    Jul 11 02:16 PM
The statement by Martin at the press conference is really interesting in what it reveals. 1. He says "They need to say what they want and propose it". That could mean that 3 of the commissioners would agree with a couple more conditions that XM would then publically agree with--basically--an approval of the merger. Or--4 different proposals from the different commissioners. That would lead to a nightmare scenerio where we could have sirius simply walk away from the merger all together. I think that Martin is simply shaking them out and putting the hammer on them to make a decision since it is on the concent agenda and that is technically the way it works. I think that we will have a couple of the commissioners wanting some extra conditions and sirius will agree to them just to get the deal done.

BTW--It seems that Sirius must have talked to Martin about the extra conditions before he agreed to talk about "being open to them"

Folks, this is all about filling congressional pockets. They will hold this merger off until Clear Channel or some other broadcasting entity gets into a position to buy XM through bankruptcy. Going on 18 months, anybody know how long does it take to fill a freezer?
  •
    Jul 11 03:51 PM
It would appear that Martin's "Grip" on this merger is loose at best, but in order for the commissioners to get what their constituencies want, the deal without deal breaking concesions, must pass. Without the merger approval none of the commissioners get anything they want. This deal will be done with leaks probably coming out next week.

    Jul 11 04:33 PM
I don't see why any of this is a surprise. I have been voicing my skepticism and encouraging all of you to consider the obstacles that stand between these companies and profitability. The FCC delay is but one of many. Political agendas here are rampant, and a strategy of attrition is evident.

The Vicar has said before and will repeat: No vote in the foreseeable future. This is a big pocket veto occurring, and you all continue to deny the obvious. Why prolong the agony? There are so many better opportunities for your money.

If you had researched these companies and their regulators thoroughly instead of treating the market as a casino or sporting event, you would all be more successful investors.

I'm just hoping that Comm. Tate has not been bought and bribed for future considerations[a job] by the NAB and democrats. These are not concessions that the NAB, georgetown partners, jessie jackson and any other free -loaders are trying to get. Let's just call it like it is "EXTORTION". Extortion to get something for nothing, or Extortion for stalling the NAB, hoping that one or both will go out of business. One possible for the NAB. Improve your product and you wont have to worry [fear], competition from sat.rad. Put your money into your product instead of taking the easy road of buying politicians to protect your inferior product.

I told you guys it is going to happen, why do you keep doughting me. As I have said before. Tate has never voted against the other two republicans. I believed the Martin press was that ether he is getting pissed at Tate for taking to long after she originally agreed in princible, or that it was lip service to two democrats. Most everyone thinks there is going to be some extra big concessions. How much you want to bet there will be at most a very very small one or two. When I say that I mean, more along the lines of giving guarantees on doing what they say they are going to do, not much more then that.

talk about doom and gloom, i have been listening to the vicar of value as he so calls himself. which is apparently a play on words i suppose. apparently, you do not have a vested interested in these two companies. well, i can assure you that i have done the reasearch on them and find them to be more than adequate investments for the long haul. you must indeed work for the NAB always giving gloomy news. do us all a favor, pick on another stock and get off of this one. this merger will go through, to much at risk for it not to. get your facts straight before trying to give an opinion, and plus, why do you even care about this. tis the same on thing vicar, you know a little about everything and a lot about nothing. just get with the program or get off. others get tired of hearing doom and gloom from you. t.m.

Ha, vicar of value, go dribble on someones else's stock. or better get a better yet, get a better attitude. all is not lost. siri and xm will prevail. the merger will take place. regardless of what the vicar says. I have faith and so should you. And if it does not, it will be bought out by someone else. the satallite arena is to important to pass up. so say goodbye to the naysayers, or should i say NAB workers. t.m.

siriusly pissed........"F.... Inc." : Sorry I had to add the "H" for emphasis. T-shirts and Hats for everyone, General Partners, capped at the first 10 in at $50 K, Limited Partners can buy in for $5K, limited to the first 1000 in. All advertising to be broadcast on Sirius (SIXM) Satellite Radio post merge. We'll register as a Terrestrial Radio Non Subscriber Advocacy Group, that's for the merger. That should be confusing enough to have credibility with any government agency that we might want to meet with.

Just to throw my .02 cents in, because that's about all I have left, on what Tate might do.

After reading an article on Sirius Buzz, reported by Tyler Savery, outlining concerns of Stifel Nicolaus' analyst Blair Levin, and how hard Tate has been lobbied by NAB, Ibiquity and all the other Special Interests looking to block or steal a piece of the pie. It would be hard for her not to pen into the agreement some details that represent these interests into the merger agreement. The following are some possibilities:

    1. At this point I don't see any way Tate will not vote with her Republican Partners and the DOJ for the merger.

    2. She will impose penalties and fines for non compliance to provide "Unfettered Open Access" in a year for manufacturing of inter-operable radios. HD chip installation issues will be removed by guarantees by the companies for "open access" and Ibequity told to let the "market" decide whether they are included in devices or not.

    3. I think, looking at spectrum compression technology down the road (or already here), she will not go along with "minority channels leased spectrum" being limited to 24 channels or to have the set aside defined by current "channel" spectrum efficiencies (Bandwidth per channel). Rather, the set aside will be defined by the current 24 channel bandwidth with channels increasing as bandwidth utilization technology improves. This will eliminate the calls for increase % of total spectrum / channels based on current technology compression and have minority channels increase with improvements in technology. A bit technical but, it does give a future increase in total channel set aside with improvements in compression technology. This could be the more significant of the concessions. While it doesn't give up more spectrum than is currently proposed, it does keep the merged company from shrinking the spectrum as technology improves, while still giving the 24 channels.

    4. I think Tate realizes the value of #3 above and will restrict, to the advantage of the merged company, who can own and administrate the set aside spectrum. This has not been discussed much but, Tate is very active in advocating for children and womens' issues. I do not feel that Georgetown Partners has veiled their minority status near enough to escape her scrutiny. I don't know how this modification to set aside will be written in, but I do believe it will prevent minority ownership from profiteering by reselling the spectrum and assure that her advocacy groups will be represented in this set aside.

I know that this is just speculation, but Adelstein might even find these kind of concessions hard to vote against along with the others already agreed too by the parties. I just feel that in voting for the merger, regardless of party, the issues raised by Georgetown, Ibiquity, Public Knowledge, and others have to somehow be addressed even if they go against their expectation. It's either now on the Record, or in court as to why they weren't addressed by the "Commission" after giving up so much time to their presentations.
  •
    Jul 13 02:16 AM
But the DOJ passed this Merger with no conditions. It should be illegal and just about criminal that the FCC's Bought Comms.. are trying to kill these companies by delaying & adding all these conditions. But i guess only the Gov can get away with criminal acts and every1 turns their head.

CLOSING THE DEAL THIS WEEK WHEN TATE RETURNS
  •
    Jul 13 10:57 AM
tech man, I dont even see him on this blog anymore what are you talking about. I use to, then after he would come back with the same thing after I rebutted what he said before, or he would not say he was wrong before just moving on to the next thing. As I have said as I get older the useless things tend to not register or just slip away to fast to even bother anymore.

I never have a problem with people wanting to discus the negitives in SIRI/XMSR. What I have a problem with is when people do what that guy, you were talking about does, as I explaned.

cos1000, As to 3. I believe that that is already part of the agreement that as the compression increases so will the channels give up to minority concerns. I think if anything, she will reqiure a certain portion of the 8% will have to be given to women. I also think the only way Adelstein votes yes on this is if there are already 3 votes for it. He if anything is waiting on Tate to see what she does, if he votes for it. If it gos that way no one should take away from that, that he was always a yes vote. There are only 2 reasons he has not voted yet. 1. That he wants to push this back as long as possible. 2. He wants to see which way the wind is blowing. Think about it, the democrats have taken almost no heat about this delay. If they want to keep it that way they will ether vote for or against it right after Tate. Then they are still in the clear. Even if they vote against, most democrats are dumb enough not to realize that and still blame the republicans for a delay. I know that seems crazy, but look, who is getting blamed now after Martin voted for it. They cant blame Martin (even though some idiots still do). They move onto Tate. I would like to know how did Adelstein and Copps get lost in the blame are they not still on the fence, where is there vote. These are the same dumb a$$es that are voting for Obama (sorry had to through that in)

Ronjsq, I like most. I do have a problem with Pfizer and Merck, I just feel with TEVA and alike out there it is getting to hard to make that much on a drug in the years between when it is developed, and the patent runs out for all the money put into them. I like TEVA more then PFE. They get the benefit of all of PFE research at almost no cost. As long as Iran doesn't blow them up I think TEVA is the better of the 2. LOL

cos1000, what I said before plus what I said in my Jun. 11, 10:20 PM post. which was basically just looking for guarantees in doing what they say they are going to do. As I said it just seems to me like common sense. I find common sense prevails everytime.

    Jul 13 12:32 PM
As far as pharmaceutical stocks go, take a look at QCOR. They're currently a niche company dealing with infantile seizures, but they've been basically printing cash for about a year now, and they have an orally dissolving hydrocodone/aceteminep... (Tylenol 3) product in the pipeline awaiting FDA approval which they anticipate could get upwards of 24% of the current Tylenol 3 scripts being written.
  •
    Jul 13 12:44 PM
163888....I agree that Adelstein will not vote yes in front of Tate, that would be political suicide for a Democratic appointee and make no sense at all at this time. Voting yes after Tate's yes vote puts him in a more "reasonable" centrist role.

Regarding the Republican Commissioner attacks, speaking for my self who votes Republican, I am very disappointed that they allowed the process to be drawn out for such a long time after the DOJ vote. There is no excuse for their hesitance when the DOJ provided them with a perfect out. They showed themselves as weak in the face of NAB funded, Democratic opposition to the deal. That speaks volumes to the criticism from Republicans towards Martin, McDowell, and Tate because they have been in a position to approve of the merge and they failed to expedite the matter to get the deal done..

On the other hand, Democrats, will always blame Republicans, no matter what, for failed policy. I do not believe anyone ever put any stock in the Democratic Commissioners voting for this deal given their historic relationship with NAB. They were and still are the opposition to the merger. Even if Adelstein votes yes, he was never going to be the swing vote for the deal and Copps was never going to be for the deal, period. I believe as justified as criticizing them would be, it wouldn't make a difference in the outcome.

The Republican Commissioners' lack of solidarity in moving the vote forward earlier opened themselves up to the criticism that I, as much as I hate to say it, believe from Republicans, they justly deserve. No decision has been a decision that has cost the Companies and Investors millions of dollars to this point. They have been more afraid of their future jobs than in providing timely decision making in their present ones. NOT ONE of them spoke up during the process regarding the BS from Georgetown or C3SR, nor did they have their Republican Senators voice much in the way of support or discovery regarding these shams.

I agree that the merger will go through, but the pain provided was not necessary.
  •
    Jul 13 01:20 PM
Cos1000...so the merger will be finalized this week? I read somewhere on the internet that there would be no FCC vote on SatRad come August 1? It's all so confusing.

Merger Mania......Even the reporters think it's confusing. I think we'll know Tate's vote by end of this week or the beginning of the week of the 21st. Reuters and Dow Jones Newswire reports Martin said he hopes for the vote to be taken on or before the next FCC meeting on August 1st. I believe even if Tate votes yes the Democratic commissioners can take another 10 days to cast their vote for the merger to formerly be approved. Given that though, once Tate's vote for the merger is known the rest is a formality and the deal will be done and the stock should start to move.

cos1000, Now on to your comment. I would agree with that, but the thing that pisses me off, is to see it on this blog when it does no good except to tell other people like us anyway. Besides we all know that if it were not for the republicans on the FCC, this would have had no chance of passing. Now I do have to say that while it was terrible the delay, and the republicans were pandering to much. I think that if the republicans controled the congress, we would have seen a faster vote on this. That is the fault of the democrats that have displayed the comments they have displayed. They are after all the ones that put the democrats in control. They are the ones that made this deal take so long, To be blaming republicans for not wanting to go against a democrat congress that they voted in is ridiculous. I think you can agree with that. If that is not irony, I dont know what is.

I do indeed agree with you that if not for the Republican Commissioners this deal would never get done. We can thank Mel for his ability to see the political climate and then move to merge when he did. I also agree that the Democrats blaming the Republicans for not getting the deal done is infuriating. It's the Democratic Commissioners, Senator's, and Attorney General's that have held the deal up. Your right about the Democratic controlled congress making it more difficult to get the deal done. How quickly the winds of political power have changed. I do feel the Republicans have squandered opportunity over the last several years while being too "War" focused. Oil / Energy policy and the economy is killing their chances. Fear not though, the Democrats can squander the best of opportunities with all of their "In-Fighting"... on what to do next. Without the Republicans to blame the will turn on each other and the Republicans will re-emerge to pick up the pieces in the mid term elections.

You can write a letter to commisioner tate at the following address,
please offer your support for the merger and take a few moments to do
    so. Here's the link:

    www.fcc.gov/commission...

Here's my letter to Mrs. Tate:

    Dear Mrs. Tate,

The recent advent of free streaming internet radio combined with
the recently approved Clear Channel merger has created an anti-
competitive bias against satellite radio providers. Although the
terrestrial radio companies have invested much to buy support, I
beseech you to resist the well paid opposition and approve the
Sirius / XM merger without any further conditions. The truth is that
satellite radio will have to fight hard to survive now; any further
delay may cripple their ability to remain solvent. I'm sure you are
concerned about the political implications of not cooperating with the
democratic pundits, however if you truly have future political
ambitions I would suggest that the public (myself included) is
watching your decision closely. The delay that the FCC has imposed on
this merger has already sacrificed billions of republican
constituent’s equity, this will not be lost from memory when your
political ambitions change from appointment offices to more publicly
controlled offices. If the power of the people is valuable to your
long term prospects, then I suggest you resist the short term benefit
gleaned by appeasing special interest groups, and do the right thing
here. Enough is enough. Please demonstrate your ability to be a fair
and offer your vote for merger approval. Thank you.

cos1000, agreed, I have to say that it has been a hard decision for me, do I vote for McCain and let him take the blame for the crap that is going to happen. Or do I just not vote, and as you said then let the republicans pick up the pieces. While I fear about judges on the courts, I cant help but feel McCain will just put in another Judge like Kennity at best. Who am I kidding I am voting a republican ticket.

163888......You had me going there....... just couldn't see you not voting at all. NotVerySmart...... good to see your comments once again- hope the market has been profitable for you. Cos1000....once again your insight amazes. Haven't had much to say lately on this merge, you guys are way out of my league on the inner workings. I find- I learn so much more just sitting back and taking it all in, then, researching from a reverse method from info picked up on all of your posts. Just wanted to say again I appreciate your work, it is very helpful.

Sirius Fan, I think your right that drug has promise. Once QCOR spends all the money to work it all out, and I have no dought that TEVA will wait till the patent runs out. Then make it for less and sell it for less for a bigger profit margin. LOL

Guys, I have just added "shure46" to the short list of people, I dont respond to anymore. We have had a debate going, on a Seeking Alpha article dated June 30th. I told him about the 600 tons of yellow cake that was sold to Canada by Iraq and it was just finished being transfered. I told him 4 times and he still says it did not happen, there was no yellow cake in Iraq. As you guys know when I have to repeat myself that many times I stop. Anyone that dumb does not get another response from me. So maybe one of you guys can tell him he is wrong, that there was the 600 tons of uranium rich yellow cake in Iraq, because as I have said I am done with him, and he obviously does not believe me. I am sure there is someone else out there that does not just watch CNN for there news, that has seen what I am talking about. God I hope so, or we are up a creek this next election.

163888........ put in a buy for 350s XMSR at 7.57. Don't have much ready cash lying around. Don't see how it could hurt, if I can get it at that price. I see XMSR just went back to even for the day, so probably not much chance of picking it up. Oh well.

163888........ it is futile to reason with a Liberal, especially far leftists, as most truely are. Fact, common sense, and reasoning are not part of their politics. They are attuned to closing their eyes and mind, operating only from a base of Elitist, stubborn, blind emotion, and I'm sorry to say ...... hate for this country, and it's military. You are truly just.............wasti... your time.

Killerkaul, I bought 500 XMSR also a few trading days ago when the spead was so big I could not resist.

As to shure46 I told him he was over matched trying to debate me on this stuff, not because I was more intelligent then him, but because he was coming from the liberal side and liberals close their eyes and ears to anything they dont want to see or hear.

Here is my letter to Ms. Tate:

    Dear Ms. Tate,

I respectfully request that you vote to approve the merger between Sirius Satillite Radio and XM Satillite Radio without further delay, concessions, or operational restrictions. Some politicians, like John Kerry, have requested that the combined company give up half the spectrum. This would be a rediculous requirement and the FCC should ignore any future statements from congressmen who make such requests, as they have no credibility. It's like requiring that Texaco and Chevron abandon half their oil fields, refineries, and gas stations in order to merge. Or like demanding that BellSouth and AT&T give up half their network and households to merge. Did anyone demand anything like that for those or any other large company mergers? Of course not. The spectrum is the company and it's future. These requests are a ploy to block the merger because these congressmen do not have the nerve to just say they are against the merger for political interests and leave it at that. These are the same people that advocate homosexual marriage as good for the USA. Demands like these must be ignored by the FCC.

    Thank You,

    Stan Muse
