I am perplexed why you are claiming that Argentina is in the dark ages and implying it is less developed than Peru. It has one of the lowest income and wealth inequalities in Latin America, with one of the highest average incomes.

The country is far more economically advanced than Peru and despite its problems, political risk and economic instability has one of the most developed business environments in Latin America.

I also find it interesting that you state that the Argentine government has always played the role of a weak middleman when despite strong protests from Spain, the rest of the EU and the U.S the government proceeded with expropriating a controlling interest in YPF from Repsol. Certainly not the actions of a weak middleman nor a government that is willing to compromise or be influenced by lobby groups. If anything they have a specific agenda in mind are not willing to compromise that agenda.

I would also hazard a guess that a key element in the courts decision comes from issues to do with ground water pollution in a country that is renowned for its natural beauty and is heavily focused on building its tourism industry. You only need to look at the environmental issues currently being played out in Peru regarding gold mining to see the damage that it does to local communities and the environment if it is not correctly executed.
