    Great question.
    They can appeal a variety of things. For example, they can appeal the verdict of invalidity re: Kiuchi or they could appeal that VirnetX did not present/calculate damages properly and thus the jury's damages number was flawed.

    However, VirnetX argues here that what they cannot appeal is anything regarding invalidity from all of the other prior art references on the asserted claims. Since they did not oppose (as a matter of law that don't invalidate the claims), they can't appeal that. So it is effectively a final ruling and they cannot continue to argue these at the Office.

    Trial going far better than I expected. Evidence clearly favored VirnetX.

    EVERY person I spoke with (even if they weren't VirnetX investors or had any affiliation) thought VirnetX will win after watching. Hopefully a jury will concur. All coming down to damages at this point IMO. We'll find out in the coming days.

    For all wondering. IMHO, the case has went very well for VirnetX thus far. Others watching the case with me in Texas concur. Again, there are no "odds" of winning. Its a jury that can do what it pleases. We will see what the next couple of days bring. 3 days down 1.5 to go.

    I'll just start at the beginning...I did not edit this. Just a quick jot of my thoughts. Quotes are close, but may not be exact.


    Cawley opened for VirnetX. Calm, someone soft spoken
    Telling story of inventors. History working for US defense/CIA
    1999 VPN/SecComm links difficult to setup, invention makes it easier.

    '135 '151
    Software looks for address; if address for secure communications is defined; auto connects

    '211 '504
    Request sent to Gabriel on SecDNS; sets up Secure communication link.

    *No mention MSFT litigation, only the settlement. No litigation mentioned all day in fact. Interesting observation.

    I thought V's timeline of events laid out was effective.

    VHC laid out licensing. Asking 1% of Apple = $700 million.

    -Apple Opens-
    Apple's lawyer was much more aggressive. Very used car salesman-ish. Stark contrast to Cawley's laid back tone.

    "Apple does not use these inventions" Focus was on royalty rate.

    Apple is a leader in innovation. Products successful without V's technology.
    "Decades of work" Success from hard work not V. FaceTime/VPN on Demand small parts of Apple's products. Again, a seemingly clear emphasis on damages.

    Focused on "determining whether" "VPN if secure" Tells jury to write down, repeatedly. At least some didn't. Not sure if they just didn't want to or if they didn't like being told.

    Apple is trying to say VPN on Demand always establishes a connection regardless of site is secure. Short later points out that of course if you set it up wrong it won't work correctly. Not sure if jury is quick enough to pick up on that at least yet. This may be the crux the Apples non-infringement case. Which seems a bit of a fine line to me...

    Apple's system is "total opposite"...

    FaceTime

    Try to make distinction between Peer to Peer and Relay servers. Trying to say connection is not direct.

    Very brief mention of Kiuchi.

    MSFT paid but we don't infringe. "We owe zero"

    Proud of inventors contributions to military "Neat story...but why are you talking about this? What does this have to do with "determining whether" "Thank you for your service, but that's not why we're here"

    -Morning Break- Jury Dismissed

    Apple: Objection to VirnetX's upcoming video demonstration of Gabriel. "We didn't know about video chat (for MAC?)"
    Cassidy for V: We sent it to them (shows email attachment source code). Claims call for video chat so they know this is relevant. We said they can use Gabriel to replace FaceTime, so they should have known it has video function.
    Davis: Objection overruled.

    That completed the first hour and a half :)

    Yes. In essence, that was the focus of my piece here. The numbers are improving and then stock price has yet to fully appreciate this. I think a focus on numbers will lead to profits for $CALL investors.

    Interesting perspective. Why do you think $CALL has been able to post considerable and increasing growth and profits over this past couple of quarters in the face of this competition? Or do you think these new competitors have yet to fully enter the market? Or is Google, Vontage , etc just validating magicJack's market and business model?
