    Thanks for the comment. I actually wrote this article before I found out that it was mainly Ackman shorting this stock. It even made more sense to me as I thought it would be very difficult for a group of short sellers to make Herbalife's share price behave the way it was.

    I am disappointed with Seeking Alpha's editors in turning down some of my articles which I then posted to this blog. I even accurately predicted the whale would be breaking bad news the week before I found out that it was Ackman behind the shorting of Herbalife. Also another great read is my blog post on "History Repeating Itself" which talks about the 2009 short attack on Herbalife and how the stock had acted and basically predicted the share price recovery that Herbalife has had since that time.

    At least you got this one right-> I am short JCP but sold 1/10/13 $7.50 put options (which will cover current short) because I expect a slow death for JCP. Most people don't realize how difficult it is to replace store volume when you lose most of your regular customers.

    NOTE: However at some time in the not to distant future it will become obvious to all that JCP is on its way out. Another one of Ackman's delusional investments. Ackman just got it reversed instead of HLF going to ZERO -> JCP is going to ZERO & HLF is going to $100 share price.

    When I invest in a company, I not only want them to address unfair accusations and/or situations- I expect them to.

    I appreciate your efforts to explain this case. As everyone who is following this debate knows, I do own shares in both companies but own significantly more shares of SIGA. I still believe SIGA will come out on top but actually hope PharmAthene does receive a significant award as it will basically be tax free as a result of their tax loss carry forwards which will offset any potential income from an award.

    MY COMMENT: So if PharmAthene, even at the date 9/9/2013, believes there are a lot of unanswered risks for the profitability of ArestvyrTM , how can they expect to receive expectation damages-> Read and research footnote #99 of the Delaware Supreme Courts opinion that further explains the requirements for an expectation damage award and adds more definitive instructions to the Delaware Supreme Court's directive "damages award consistent with this opinion":


    "99 An expectation damages award presupposes that the plaintiff can prove damages with reasonable certainty. Callahan v. Rafail, 2001 WL 283012, at *1 (Del. Super. Mar. 16, 2001)(citation omitted) ("It is well settled law that 'a recovery for lost profits will be allowed only if their loss is capable of being proved, with a reasonable degree of certainty. **********No recovery can be had for loss of profits which are determined to be uncertain, contingent, conjectural, or speculative.**********...

  • Ackman Still On Side Of The 'Angels' In Spite Of Mark To Market Loss [View article]
    Matt-> "I have fallen and I can't get up"
    My answer-> "Call 911 and cover your HLF short"

    PREDICTIONS:
    1) Ackman is and has been in the process of covering his HLF short over the last 2 quarters (NOTE: Telling everyone that he sold puts (I believe cheap puts way out of money) was his way to make other shorts stay in the game & not cover)

    2) If Ackman hasn't covered all of his shorts by December 31 of this year 2013- he will have covered a significant amount of them & will have another "Put story" to save face & to try to prevent other shorts from covering (THOUGH I wouldn't be surprised if he had covered by Dec 31 or shortly(within days) thereafter.

    3) The moment Ackman has found his way out of the trade, these articles by Matt & Quoth will disappear = coincidence = hmmmmm = I think NOT

    NOTE: If you were Shane Dineen, you would like to be as far away from this as possible- wouldn't you? So where in the World is WALDO?????

    SHORT SQUEEZE is still coming!!!

    As already mentioned- shorts have to get through all the stages of grief-

    Denial
    Anger
    Bargaining
    Depression
    Acceptance

    To try to figure out where most shorts are at in this process, we need to only look at the title of this article- "Can I Get Bullish On Herbalife Now?"

    From this title we can see the author is doing a little bargaining but then responds- "absolutely not." which seems to indicate a combination of denial & anger.

    So I think as HLF's share price rises even further, we may see some signs of depression and then when their leader, Bill Ackman, announces he has snuck out of his position losing billions of dollars for his investors, I believe acceptance will occur and HLF's share price will be off to the races and will exceed $100 per share!!!!!

  • A Case For Buying Both Siga And PharmAthene [View article]
    One of my contentions is that both companies made mistakes in the overall attempt at either merging or signing a licensing agreement. At minimum- if there is an attempt at signing any type of agreement, between companies, the attorneys should include a provision that specifically defines the damages from the party backing out of the agreement. The court system should not be relied upon to determine outcomes of incomplete documents.

    Apparently Theraclone's attorneys were smart enough to put a termination fee in their merger agreement. What a profound thought. Here is the title, excerpt & link- "PharmAthene Announces Termination Of Merger Agreement With Theraclone Sciences" - EXCERPT-> "Accordingly, PharmAthene has cancelled the Special Meeting of Stockholders scheduled for December 3, 2013 and will pay Theraclone a $1 million termination fee"

    So if PharmAthene is allowed to introduce new evidence, I would think SIGA should be able to introduce the fact that a proper termination fee should only be a million dollars not a lotto winning ticket award!! Judge Parsons are you listening??

    Ackman finally figured out JC Penney but it took him a little while and a lot of his client's money NOW he's a little slow on Herbalife but you can bet your bottom dollar that he won't clue in other shorts while he tries to find a way to the exit.
