Jeremy Frommer has 20 years of industry experience and is currently responsible for general management and leadership of the General Partner. Previously, Mr. Frommer was a Managing Director and Head of the Global Prime Services Group (“GPS”) at RBC Capital Markets (“RBC”) and was a member of the RBC Global Equities Operating Committee. GPS was a provider of innovative financial services and customized trading technologies for institutional trading desks, hedge funds and individuals. GPS encompassed five business divisions, as well as the Electronic Trading Development Group. Mr. Frommer oversaw in excess of 120 professionals, including a 20-person programming group, ...More and managed the Professional Trading Division, which housed nearly 300 independent traders. Mr. Frommer moved to RBC through its acquisition of Carlin Financial Group (“Carlin”), where he held the position of CEO. Over three years, he is credited with having doubled Carlin's Institutional Sales desk in size and volume while turning Accel, the company's full service direct market access trading system, into a fixture on the trading desks of leading hedge funds across the country. This rapid growth, generated by Mr. Frommer and his team, attracted the attention of RBC Capital Markets Corporation which acquired Carlin on January 2, 2007. While at Carlin, Mr. Frommer oversaw nearly 120 professionals and was the Head of Generic Trading, a broker-dealer affiliate of Carlin servicing nearly 500 independent professional traders. Prior to Carlin, Mr. Frommer was the founder and CEO of NextGen Trading, where he and his development team created proprietary arbitrage trading software, oversaw a group of 30 proprietary traders and a ten-person event-driven sell side trading desk specializing in algorithmic execution. NextGen Trading began its integration with Carlin in 2002, first as an affiliate, and then completed a merger with Carlin in late 2004. Mr. Frommer was named interim CFO of Carlin during the integration period.
Prior to spending eight years as an entrepreneur and senior corporate manager as detailed above, Mr. Frommer spent time as a Managing Director at Bank of America Securities and a Director at the Royal Bank of Canada. In both positions, he was the Head Portfolio Manager of the Event-Driven Proprietary Trading Group, managing portfolios as large as $1 billion. Mr. Frommer has also held a number of senior positions at other financial institutions, including at Guard Hill Capital as Head Trader, at Bankers Trust as Head Trader of the Principal Investing Group, and at Kidder Peabody &amp; Co., where he underwent his credit training. It was at this early juncture in his career when he started to build professional relationships with both Alan Portnoi and Dean Machado that would lead to the construction of the majority of the General Partner’s senior management team. Mr. Frommer holds a B.A. degree in Philosophy from State University of New York at Albany where he graduated magna cum laude and has studied philosophy at the London School of Economics.
In his later life, Mr. Frommer has taken up the practice of yoga, and he imparts his newfound hobby upon his HFL colleagues. He fashions himself a moral realist. Apart from his Wall Street endeavors, Mr. Frommer is an owner of Overnight Productions, a film and television production company in which he is partnered with acclaimed producer Rick Schwartz, as well as 1OAK, a Manhattan hotspot managed by Scott Sartiano and Richie Akiva.</description>

It was a strong stock  today in a weak market. Over the past four trading sessions the stock has been  making higher highs and higher lows, a indication of a bullish move.&nbsp; There is  widening of the moving averages and looks like the 15SMA will cross&nbsp;above  through the 20SMA.&nbsp; PLCM is trading near its 52 weeks highs of 61.70. Tomorrow,  look for the continuation of todays move and for resistnace at the 52 weeek  high.&nbsp;The level of support to watch is the 8SMA 58.15.Intra day there are two  levels of support first is 60.60 and then 59.91&nbsp;Right now look to be cautious  with any trades given the current way the market is trading. There is room for  this stock to go if it has the strength to break through the highs. If the 8SMA  does not act as support and trades through there look at 57.50 as&nbsp; the next  support level.</p>]]>

As  it is confirmed by the Shiller Index and the most recent housing report from  Zillow.com, it seems as though real estate is now in a definitive double dip  mode. BAC, one of the largest mortgage writers is facing higher and higher  default rates. It will be interesting to see how the largest bank by market cap  will try to move around a shrinking balance sheet this time.       <title>Sommer Sensation: Closing Argument on Behalf of Michael Kimelman at Zvi Goffer Trial </title>

        <![CDATA[&nbsp;What follows below is Part 1 of Michael Sommer&rsquo;s closing&nbsp;argument&nbsp;made to the  jury yesterday as the trial of Zvi Goffer, his brother Emanuel Goffer and  Michael Kimelman winds down.&nbsp;&nbsp;&nbsp;The&nbsp;closing argument&nbsp;was divided into two parts  as the jury needed to be excused at 5:30pm.&nbsp; Mr. Sommer&rsquo;s remarks followed those  by each of&nbsp;Zvi Goffer&rsquo;s attorneys, and&nbsp;Michael Ross, the attorney for Emmanuel  Goffer.&nbsp; <p>The government began this final phase of the 2 week old trial with its own  summation of the evidence, after whiich it was clear that all the defendants had  some work to do.&nbsp; Mr. Sommer&rsquo;s closing was extremely powerful, and both&nbsp;his  legal and oratory skills were on&nbsp;full display as he sought to convince the jury  that his client,&nbsp;Mr. Kimelman, was an innocent man.&nbsp;</p> <p>Mr. Sommer&rsquo;s&nbsp;closing remarks concluded this morning, and were followed by a  short rebuttal by the government.&nbsp; More on that in my next blog.&nbsp;</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; THE COURT:&nbsp; We will now have the summation on behalf</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 6&nbsp;&nbsp;&nbsp; of Mr. Kimelman by Mr. Sommer.&nbsp; Sommers.</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 7&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; MR. 2&nbsp;&nbsp;&nbsp; when it came to Mike, unsupported by evidence, and that the</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 3&nbsp;&nbsp;&nbsp; prosecution&rsquo;s case against Michael Kimelman simply made no</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 4&nbsp;&nbsp;&nbsp; sense.</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 5&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; I stand before you today two weeks after I made  that</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 6&nbsp;&nbsp;&nbsp; commitment, to explain that just what I said would happen is</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 7&nbsp;&nbsp;&nbsp; what has come to pass in this courtroom.&nbsp; I stand here to  tell</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 8&nbsp;&nbsp;&nbsp; you that the prosecution&rsquo;s case against Michael Kimelman is</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 9&nbsp;&nbsp;&nbsp; flawed to its core.&nbsp; It is bogus.&nbsp; It is unjust.&nbsp; What went  on</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 10&nbsp;&nbsp;&nbsp; in this courtroom over the last two weeks with respect to  Mike</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 11&nbsp;&nbsp;&nbsp; was wrong.&nbsp; The prosecution charged a man with crimes when  he</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 12&nbsp;&nbsp;&nbsp; committed no crimes.&nbsp; And they stubbornly pursued their case</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 13&nbsp;&nbsp;&nbsp; even though they knew, as you now know, that their charges  and</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 14&nbsp;&nbsp;&nbsp; theories were unfounded.</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 15&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; You know, the prosecutors told you in their opening</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 16&nbsp;&nbsp;&nbsp; statement that they would prove that Mike was a member of a</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 17&nbsp;&nbsp;&nbsp; conspiracy, whose illegal goal was to engage in insider  trading</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 18&nbsp;&nbsp;&nbsp; and that he engaged in insider trading in connection with  his</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 19&nbsp;&nbsp;&nbsp; trades of 3Com stock.&nbsp; That&rsquo;s what they told you they would</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 20&nbsp;&nbsp;&nbsp; prove at this trial.</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 21&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; And we come now, two weeks down the road, and what</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 22&nbsp;&nbsp;&nbsp; have you learned?&nbsp; You&rsquo;ve learned that the prosecution&rsquo;s  theory</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 23&nbsp;&nbsp;&nbsp; is completely false when it comes to Mike.&nbsp; Mike Kimelman  was</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 3&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Ladies and gentlemen, you want a line in the sand?</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 4&nbsp;&nbsp;&nbsp; I&rsquo;ll give you one.&nbsp; A line in the sand when it comes to  Michael</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 5&nbsp;&nbsp;&nbsp; Kimelman.&nbsp; On March 25, 2008, when Brien Santarlas had seen</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 6&nbsp;&nbsp;&nbsp; that conference room at Ropes &amp; Gray set up for what he  thought</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 7&nbsp;&nbsp;&nbsp; was a closing for Clear Channel, CCU, he passed that</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 8&nbsp;&nbsp;&nbsp; information on to Jason Goldfarb, who the prosecution says  then</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 9&nbsp;&nbsp;&nbsp; passed it on to Zvi Goffer, and then the flurry of phone  calls</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 10&nbsp;&nbsp;&nbsp; started.&nbsp; You can see it in this chart.&nbsp; Zvi to Craig  Drimal,</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 11&nbsp;&nbsp;&nbsp; Craig Drimal to Zvi, Jason Goldfarb, Zvi to Raj Rajaratnam.</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 12&nbsp;&nbsp;&nbsp; And you heard those tapes.&nbsp; I played them for you.&nbsp; Every  one</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 13&nbsp;&nbsp;&nbsp; of these call was about two guys at the firm, Santarlas and</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 14&nbsp;&nbsp;&nbsp; Cutillo.&nbsp; And that the lawyers at Ropes &amp; Gray were  working</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 15&nbsp;&nbsp;&nbsp; that night to get the closing done, to revise documents, no  one</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 16&nbsp;&nbsp;&nbsp; was going home.&nbsp; It was in the highest hands at the firm.&nbsp;  Do</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 17&nbsp;&nbsp;&nbsp; you remember all that?</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 18&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; And then Zvi Goffer called Mike Kimelman.&nbsp; Now, as</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 19&nbsp;&nbsp;&nbsp; that tape was cued up to be played, you must have all  assumed</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 20&nbsp;&nbsp;&nbsp; that you would hear more of the same.&nbsp; That you would hear  Zvi</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 21&nbsp;&nbsp;&nbsp; tell Mike just what everyone else was being told.&nbsp; Lawyers</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 22&nbsp;&nbsp;&nbsp; working late.&nbsp; Documents being revised.&nbsp; Two guys giving us  the</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 23&nbsp;&nbsp;&nbsp;         <![CDATA[&nbsp;What follows below is Part 1 of Michael Sommer&rsquo;s closing&nbsp;argument&nbsp;made to the  jury yesterday as the trial of Zvi Goffer, his brother Emanuel Goffer and  Michael Kimelman winds down.&nbsp;&nbsp;&nbsp;The&nbsp;closing argument&nbsp;was divided into two parts  as the jury needed to be excused at 5:30pm.&nbsp; Mr. Sommer&rsquo;s remarks followed those  by each of&nbsp;Zvi Goffer&rsquo;s attorneys, and&nbsp;Michael Ross, the attorney for Emmanuel  Goffer.&nbsp; <p>The government began this final phase of the 2 week old trial with its own  summation of the evidence, after whiich it was clear that all the defendants had  some work to do.&nbsp; Mr. Sommer&rsquo;s closing was extremely powerful, and both&nbsp;his  legal and oratory skills were on&nbsp;full display as he sought to convince the jury  that his client,&nbsp;Mr. Kimelman, was an innocent man.&nbsp;</p> <p>Mr. Sommer&rsquo;s&nbsp;closing remarks concluded this morning, and were followed by a  short rebuttal by the government.&nbsp; More on that in my next blog.&nbsp;</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; THE COURT:&nbsp; We will now have the summation on behalf</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 6&nbsp;&nbsp;&nbsp; of Mr. Kimelman by Mr. Sommer.&nbsp; Sommers.</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 7&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; MR. 8&nbsp;&nbsp;&nbsp; you that the prosecution&rsquo;s case against Michael Kimelman is</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 9&nbsp;&nbsp;&nbsp; flawed to its core.&nbsp; It is bogus.&nbsp; It is unjust.&nbsp; What went  on</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 10&nbsp;&nbsp;&nbsp; in this courtroom over the last two weeks with respect to  Mike</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 11&nbsp;&nbsp;&nbsp; was wrong.&nbsp; The prosecution charged a man with crimes when  he</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 12&nbsp;&nbsp;&nbsp; committed no crimes.&nbsp; And they stubbornly pursued their case</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 13&nbsp;&nbsp;&nbsp; even though they knew, as you now know, that their charges  and</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 14&nbsp;&nbsp;&nbsp; theories were unfounded.</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 15&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; You know, the prosecutors told you in their opening</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 16&nbsp;&nbsp;&nbsp; statement that they would prove that Mike was a member of a</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 17&nbsp;&nbsp;&nbsp; conspiracy, whose illegal goal was to engage in insider  trading</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 18&nbsp;&nbsp;&nbsp; and that he engaged in insider trading in connection with  his</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 19&nbsp;&nbsp;&nbsp; trades of 3Com stock.&nbsp; That&rsquo;s what they told you they would</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 20&nbsp;&nbsp;&nbsp; prove at this trial.</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; A line in the sand when it comes to  Michael</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 5&nbsp;&nbsp;&nbsp; Kimelman.&nbsp; On March 25, 2008, when Brien Santarlas had seen</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 6&nbsp;&nbsp;&nbsp; that conference room at Ropes &amp; Gray set up for what he  thought</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 7&nbsp;&nbsp;&nbsp; was a closing for Clear Channel, CCU, he passed that</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 8&nbsp;&nbsp;&nbsp; information on to Jason Goldfarb, who the prosecution says  then</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 9&nbsp;&nbsp;&nbsp; passed it on to Zvi Goffer, and then the flurry of phone  calls</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 10&nbsp;&nbsp;&nbsp; started.&nbsp; You can see it in this chart.&nbsp; Zvi to Craig  Drimal,</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 11&nbsp;&nbsp;&nbsp; Craig Drimal to Zvi, Jason Goldfarb, Zvi to Raj Rajaratnam.</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 14&nbsp;&nbsp;&nbsp; Cutillo.&nbsp; And that the lawyers at Ropes &amp; Gray were  working</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 15&nbsp;&nbsp;&nbsp; that night to get the closing done, to revise documents, no  one</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 16&nbsp;&nbsp;&nbsp; was going home.&nbsp; It was in the highest hands at the firm.&nbsp;  Do</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 17&nbsp;&nbsp;&nbsp; you remember all that?</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 18&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; And then Zvi Goffer called Mike Kimelman.&nbsp; Now, as</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 19&nbsp;&nbsp;&nbsp; that tape was cued up to be played, you must have all  assumed</p> <p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;
