This article was published on May 29, 2012. The ITC Joint Motion to Extend the Deadline for the Second Settlement Conference came about three weeks after publication. This new motion to extend may hold significance, but the simple scheduling of the First (March 15) and Second (June 27) Settlement Conferences are a routine part of the investigation.
The procedural schedule for the ITC dispute has been known for many, many months. My article did not include every upcoming item on the schedule, including the Exchange of Reports, Expert Discovery Completion, and the Second Settlement Conference.

It looks liked the ALJ at the ITC allowed for a minor scheduling modifcation, but denied the VirnetX and Apple joint motion requesting an extension. The hearing and target dates have not changed.

Hello, I am making this comment to give a heads-up that there will most likely be a scheduling modifcation with the dispute being heard by the International Trade Commission [ITC]. I just learned today that VirnetX and Apple are jointly proposing an extension of certain target dates - including an extension of the Hearing date that was originally scheduled to begin on Sept. 5, 2012. The Hearing will now most likely be scheduled for March 2013 and other key dates will be pushed back 5-6 months as well.
In context of this article, this proposed scheduling change at the ITC will most likely releive some pressure Apple may be facing when contemplating their legal strategy. There has been no change (or proposals for modification) to the trial schedule in the Disctrict Court litigation.

Hi, whcnysesavhc, and thank you for your comment. You ask some difficult questions regarding a takeout of VirnetX. First, I think it is near-impossible to accurately assign a probability to VirnetX being bought out by one of the defendants. There is definitely some logic behind the notion and I am sure both Apple and Cisco have been (or are currently) considering it. However, I would say the odds of it actually happening are low. There are many factors involved including the structure of principal share ownership - as well as the fact that VirnetX is still in its infancy in regards to actual revenue generation. Acquisitions of this size (VHC is already worth $1.5 billion as of today's stock price) are generally complex and require a lot of questions to be asked and answered before any action is taken. One could make the argument that it is too early for many of those types of questions to have finite answers, especially considering LTE-Advanced has yet to be introduced to wireless consumers. So while I think the chances of a buyout are on the low side, I also do not think think it would be a major surprise if it were to happen.

hi Zee, and thanks for commenting. There are statements made in the court filings as well as with the U.S. Patent & Trademark office asserting prior art and other defenses. Microsoft made similar assertions a few years back and they ended up losing a jury trial as well as settling for a dollar amount greater than the jury award.
