    research
    construct investment thesis
    review info as it emerges/unfolds
    Wash. rinse. repeat

    I am not aware of any information that leads me to believe Herbalife is a legitimate business. that is my thesis.

    we'll see how it turns out.

    my investment position has changed over time too...

    the difference is...your speculation makes no sense...POST is not Stiritz personal playground...it is a public company...ironically..... competes with POST as a meal replacement vendor...mostly breakfast...

    shocks me that the POST board lets Stiritz drag his name into this drama...

    but...what do I know?

    only thing that makes sense is that Ramey was damaged goods with DA insiders fed-up with MLM scrutiny...turns the brand into a bucket shop...

    today someone bought 1,400 60 Puts over Friday and another 2,000 Feb 22 $50 Puts...

    someone expecting to buy your shares at a much lower level...

    by the way...have never asked to have any of your comments deleted...editors review the boards...not me...your ad hominem attacks do not phase me one iota...an argument without evidence is like a cowboy who is "all hat and no cattle"...

    daily stock price movements are noise v. the underlying investment thesis...is HLF a pyramid scheme or not?

    that is the question...

    Q. If you were Mr. Stiritz...wouldn't you want Ramey still sitting at DA churning out uber-bullish research? Why mess with a good thing?

    Ramey to POST is an obvious patronage appointment.

    As for Dinneen. If Ackman wanted to throw Dinneen under the bus for HLF he would have abandoned his position. HLF idea came from author of Confidnce Game anyway - not Dinneen. Shane analyzed the company and did so finely I might add.

    I pointed out that Nuskin's pricing structure does not price discriminate against distributors and therefore does not have the inventory loading incentives that are the hallmark of the Herbalife con...Nuskin may still oversaturate end-markets with distributors/recruit ad nauseum...

    but...it's marketing plan is certainly not as monstrous as Herbalife's

    Herbalife's scheme guarantees failure for junior recruits...only Supervisors stand even a remote chance of success as a retailer...

    I am saying inventory loading is illegal and is a primary indicia of a pyramid scheme. In practice, the "pay to play" or "buy your discount" incentive is what leads to discrimination v. the Members at the lowest levels of the HLF pay plan...

    even without inventory loading, the pay plan sponsors saturation...with it the damage is amplified like a steroid injection to a baseball slugger...

    what I am saying is that it isn't relevant to the fraud...the fraud occurs because the distribution model oversaturates end-markets....oversta... leads to price wars between distributors

    price wars lower the retail price of product...actual retail process are 35% off SRP...

    thi smakes it impossible for anyone to make money unless a SUPERVISOR...even if inventory is sold through/consumed this does not make the venture profitable...

    you can't have it both ways...if you say all of the inventory sells through, that there is no evidence of product returns then why do so many distributors quit?

    the only logical answer is because they do not make a ROIC (including time, $, reputation, friendships, etc.)...

    the churn data trumps every other argument you make...it is the central evidence of business failure...year after year after year after year...which makes the entire enterprise dependent upon recruiting...

    it is a problem for obvious reasons...personal consumption is not evidence of a profitable business venture...junior distributors stand little to no chance to make any kind of retail profits...even if they sell-through their inventory they don't make any money...

    you have to be a SUPERVISOR to even have a chance at making small potatoes...

    Imagine tomorrow you invent the cure for global obesity in your basement laboratory. I think big Pharma companies spend billions on R&D to develop patented drugs that they can sell exclusively by way of example...

    would you:
    a) Limit or proliferate the number of people who could sell your product?
    b) charge a high or low price for the right to distribute?
    c) pay a high or low % of revenues to salespeople as commissions?
    d) expect your salespeople to resign or remain loyal?

    If Formula 1 was the magical solution you describe instead of an over-priced Placebo that is a perfect substitute for pretty much every protein powder on the market...there isn't a snowball's chance in hell it would be sold through MLM...

    your product is not shake mix...it is "THE AMERICAN DREAM" disguised in the form of a canister...

    most figure this out in less than 12 months...which is how much residual time you have left b4 regulators shut you down...
