    The only problem with this is that GBSN is hard to borrow. Interactive Brokers currently lists the borrow at 82.5% APR.

    I would absolutely disagree. Free speech is not free enough if people have to be scared of criticizing companies for fear of being sued. Libel law works for the rich here. It works even better for the rich in Europe where courts can issue secret orders banning people from even mentioning a topic:

    Reporting information to a regulator is not covered by tortious interference. For example look at Ackman trying to get the US government to declare HLF an illegal pyramid scheme. He has better legal advice than you or I and submitting (true) information to the marijuana review boards seems quite similar to what the Ackman has been doing.

    One thing that Finston did not mention is that companies that sue critics to silence them potentially violate the securities laws against issuer retaliation. Unfortunately the SEC has never enforced that. See for example

    Here is one obvious falsehood in your article:

    "Moreover, institutional investors in these issuances have agreed to favorable prices ranging from $0.33 to $0.40 per share. Barely priced below the Volume Weighted Average Price ("VWAP"), these issuances are particularly friendly to common shareholders given the early stage of this company."

    The problem with this is that most of those share issuances came prior to August 2014 at which point the stock did a 14 for 1 forward split. See - "Security Notes
    Capital Change=shs increased by 14 for 1 split. Payable upon surrender.. Ex-date=08/30/2013."

    So those 1.05 million shares became 14.7 million shares with a cost basis of $388,995 total or $0.02646 per share. Assuming that it was the same or related invidivuals / funds buying those shares as the later shares (post-split), then those people/funds invested $688,995 for 15.45 million shares at an average price for all the shares of $0.044595 per share. There is a very big difference between that average price and the current price. In fact how they make their money is they pay for a pump (say $1m), and then sell 14 million shares at an average price of $0.20 (I'm assuming their selling creates a big dump, as almost always happens). Those share sales net them $2.8m and they end up with $1.1m in pure profit. And that is pretty much the worst case scenario for them.

    It is perfectly legal to short penny stocks although it is usually very hard to find shares to short. Most brokers don't allow shorting of penny stocks. Interactive Brokers is one that does.

    I find the timing of this article to be rather suspicious. Prior to yesterday VOIL had traded almost no volume. That means that you decided to write this after only one day of light volume. Also, today a stock promotion began on VOIL: see

    This is not the first time you have written a positive article on a low-volume OTC pump and dump. Your April 17th article on PBFI ( ) came less than two weeks after the stock first started trading and it started to get pumped. From $0.60 when you wrote about it PBFI is down over 60% on low volume. I blogged about the PBFI pump and dump here:

    In neither article do you talk about the company's almost asset-free balance sheet (VOIL has only $162k in total assets as of the most recent 10-Q: ). You are either hopelessly naive in believing that these are legitimate companies (rather than companies that exist for the primary purpose of being pumped and dumped) or you are in on the pump. Either way investors should steer clear of Virtus Oil (OTCQB:VOIL) and any other OTC stock you recommend.
