    The article got my attention enough to examine the conference call prior to this earnings release; however, I have not reviewed HITK's most recent Report. The information recorded below only consists of things that to me have made a case against shorting the stock. Maybe you would care to address each here or in a different article, "e." below in particular?

    a. Currently has 14 products awaiting FDA approval and 20 additional products in active development...clinical...

    b. Launch of NasalEase

    c. Increased sales over Bupap and Dexpak line and more recently acquired TussiCaps and Orbivan (TussiCaps will have a much stronger year in sales...more opportunity to train sales representatives)

    d. Successful launch of newest Zostrix hot and cold therapy, including the two leading drug chains in the country [WAG & CVS?]

    Analyst Q&A:
    e. CEO David Seltzer says revenue can be expected to be above $230 million...Williams Peters CFO, definitely second half loaded.

    f. Four more unit dose products to the market this fiscal year...enough product launches and pipeline for good to decent year. [later four products requiring clinical trials at least a year out].

    g. Margins recently hurt by one time pricing promotions.

    h. Cost cutting and efficiencies for second half of year margin expansion.

    In my opinion there is at least some merit to this article's claims.

    As a detail, I remember Blackstone making a $2 billion buy in to Cheniere's high yielding CQP ticker symbol and was unaware of a Blackrock stake.

    I have been following this since reading the article (and observe some statements by management that appear to at least partially mitigate the company's immediate concerns). It makes sense that the share price is appreciating with the special dividend announcement. Maybe the time to look for an ideal entry point to sell it short would be tomorrow, the day before earnings?

    Thanks for the ZTE update.

    From the sound of things, an injunction can be obtained in Mannheim, Germany. I have not seen the text of the complaint. The phrase that is floating around is "Prayer for relief:" maybe it is a fair description of Vringo's European suit? Though they are not just looking for an injunction, it is not so easy to say what else may be feasible.

    The following is pure speculation: perhaps a German injunction can be presented to the ITC and in turn affect ZTE's ability to sell here in the USA?

    I like the article, having found it because AZO is being considered.

    As rising taxes on dividends are another imminent concern, there could be other variations of the strategy described by the author. A different take on the budget gridlock situation might involve choosing stocks of companies that are likely to do well during a downturn, and have an aggressive share repurchase program--instead of a dividend. AZO appears to fit the description. Its earnings report merits evaluation.

    This is one of those winners. Unfortunately, I keep realizing how well it does in hindsight. There are only so many companies that appreciate capital the way PCLN, PNRA, or AZO have done. There are some signs of a turning economy in Mexico, and to my memory, Autozone has some stores there while its competition does not.

    Another one with an aggressive buyback is VMED. Perhaps similar to AZO, the decision not to invest in it has been regrettable.

    There are many who are waiting for some of Vringo's claims to bear fruit and I prefer not to upset or anger anyone.

    However, according to this guy's patent law blog, the High Court of Justice, based in London, is "The most defendant-friendly patent court in the world...Only 15% of UK patent claims result in a finding of violation." Why has Vringo filed its initial ZTE claim there? Perhaps Mannheim District Court is so much faster that a favorable ruling, and probable injunction, tactically amount to settlement leverage despite the other suit?

    Bartongrasshopper's comment above is directed at the author. Being familiar with the story, let me say that the conference could provide an improved entry point, approximately during the second week of December, for patent assertion businesses. For reference, The Wall Street Journal has twice recently run multiple stories about IP,only on Mondays, and places the articles in its Marketplace section (Maybe they are easier to find in their online edition?).

    Any other resources or background information about PTNT would be welcome!
