    While I've clearly pointed out the issues with the current valuation, I still like the company long at the right price. It's not a ponzi scheme, they simply invest the proceeds in relatively risky assets (credit risk) and use leverage like other REITS (interest rate risk) so they can get the high yield to pay out.

    I'm down more than that. But the valuation is now far out-of-line and they need the cash. If the price stays at this level its a no-brainer.

    Like I said in my previous article, I like the stock long for many reasons, and I plan to cover my short and buy back long once they do their next deal.

    It's just a matter of valuation. At 6.85, there wasn't enough premium to do the deal.

    Interesting article. I agree with you that nymt is way over valued here but Steve is a solid guy. My fund has taken some actions because of valuation but I would be a buyer closer to book. Your estimate of 6.38 look accurate. I don't understand the long thesis at this valuation.

    If you read the ruling it says that BDT didn’t violate Section 337 (which apparently was only due to a technicality) but that doesn’t really matter. The important part is that the patents were upheld and domestic courts will only look at this and don’t care about Section 337 since that is an international issue. The domestic courts will rule in favor of Overland and award damages.

    I find it highly coincidental that this article heavily promoting Ampio, along with a large run-up in the stock today, happens on the day before the restriction is lifted on insider sales.

    "On October 5, 2011, the Ampio Board of Directors approved a modified lock-up program under which certain former BioSciences stockholders who voluntarily agreed to a six-month extension of existing lock-up restrictions to June 30, 2012"

    Ok, so let me see if I have this straight. They filed for an $80 million offering, which would have been in excess of 11 million shares at $7. They did the offering and were only able to place 2.2 million shares at $4.25. So, you're going to tell me that there was some big institutional buy in? You're too funny.

    I don't see where most of the questions got addressed. Why did they do business with Redwood when Redwood was apparently involved with a number of pump and dump schemes? Why haven't they denied giving stock to promoters? What about the stock becoming unrestricted at year-end? Why no major biotech funds with positions? And with tramadol, why would a doctor ever prescribe Zertane when the generic is readily available?
