Jason, where you are also incorrect is that for infringement only one of the six claims needed to be found valid. In the innital decision all six claims were found valid. In this updated decision it is possible that one or two of the six claims may not hold up. That does not matter in the ITC or the federal court. Only one claim has to hold up for there to be patent infringement. Also the finding on the limitation "linear array" is very important in all open cases in federal court because it makes the argument that no matter what array format is used it is still a violation of a patented array. In my opinion, there will be a lot of money paid to Overland when the settlements and federal court decisions come in. This final decision only speeds up the process of settlements for other defendants. This was strike three for outstanding defendants in my opinion. Overland should be getting some phone calls this week.

You are completely wrong in your analysis of the printed materials argument. The decision strengthens the case against bdt and other defendants in federal court and if a economic industry is deemed to exist in the march decision then bdt product imports should stop in my opinion. Read the decision again and try another article clairfying you mistaken analysis. Best
