Appeal can not appeal just because they lost, Apple has to appeal on the grounds that the judge misconstrued the law in some way. Looking at the Judge's order as in my last article, I do not think they will get anywhere with an appeal, but they definitely will appeal.

The royalty rate will from Apple alone will be a substantial amount. Coupled with the damages and a total earnings from the rate over the course of a few years it should be north a billion or two dollars, from Apple alone all together.
Second, they will receive a set royalty rate for the life of the patents so 10 years.
Cisco has been slated for willful infringement since they discuss the VirnetX technology in their product manuals and openly infringe.
Second, Cisco has been accused of infringing the '135, '504, '211 patents just as Apple has been. Cisco is also infringing upon the '180 patent and the '759 patent which is unique from the Apple case.
I do not expect the trial to be a walk in the park, or short in time; but I do think VirnetX will have no problem at all proving willful infringement and being victorious.

VirnetX has a lot to gain from the royalty rate, it will be a large amount. Although there is a lot more to the company than simply their winnings, their technology and intellectual property is incredible!

The royalty rate has been argued using the cheapest model of each device, say the 16gb Iphone instead of the 32gb. This makes for a stronger argument, and it is fair since VHC should not profit more just because Apple but more gigabytes of hard drive space in the Iphone.
That being said the Iphone and Ipad will most likely follow the 1% rate, I am not sure about the break down of macs and related software but I believe the rate for macs is lower because it is based on the software.
Samsung is not a current litigant as they do not offer real time secure communication applications to the degree that Apple does with Facetime and iMessage. Samsung will most likely have to come back later and license with VirnetX for their 4G patents though.
Yes VirnetX will profit hugely from this, thats why all of the information surrounding the company is so important and news worthy; but also requires a lot of due diligence by investors looking to get involved.

It is up for argument as to whether the case can be brought up in other cases, as to whether a judge would allow it etc. To my knowledge it can be if the reference applies to the specific case and point involved while arguing in court. You cant just say VHC won so Vringo wins.
I am sure though that this case will affect many other cases in the IP space, further compounding the fact that owners of IP should be compensated fairly.
