    Well, the point of the matter is that filing these IPRs are not cheap, and required a vast amount of technical knowledge (personal or hired) and legal expertise (and payment) to file these.

    That is one of the main points why VirnetX is in the drivers seat, and they can either go through with it and seek discovery in Texas (recommend transfer) or just terminate it and get back to the other current events.

    Honestly I see VHC wanting to just get this over with and let it go, although it is equally likely they can take it and seek discovery to dissuade any potential other companies/hedge-funds/... from filing these IPRs - especially since New Bay was seeking 10% of the judgement from the Apple trial

    Bill, great straight-forward article with no slant and an upfront disclosure that you will not speculate on the share price!

    Bill if in the case the Google starts to move closer to Apple, from going over to less over valued... do you think that Google being held to a different standard will change quickly - such as over one bad call or slight miss, or over time if Apple moves up in valuation as well?

    Thanks for reading and commenting Michael. I agree I had a BlackBerry Pearl a while ago and I enjoyed BBM - and I think it can be a foundational building block for another company, just not Apple.

    1. Nah what?

    2. Microsoft releasing a Skype app is not a workaround? They can infringe if their is a Skype App, they infringe more then through volume. Moreover you are assuming even if it was a work around, which it isn't, that everyone using FaceTime would automatically switch to Skype.

    3. How is this a workaround? VirnetX has asserted another lawsuit against Microsoft since Skype fell outside of the original Settlement of $200 million dollars. So this is NOT a work around.

    4. Ransom? You must not be following any of the settements, jury awards or litigation that has been on going. Moreover you may need to research the technology more to fully understand how Apple and other companies do infringe before assuming that they dont.

    5. You have posted 4 comments to spam the comments section since you do not understand the article or realm of the company whether it be the litigation or the technology. I welcome criticism that is well founded and can be constructive, not blatant spam that serves no purpose.

    6. As to your other comment "stealing" was taken out of context and makes sense where I used it.

    They are paying a legal game and they are not going to get away with it. I know its hard for the Apple customers and shareholders to see, but once their service is degraded and another company provides VHC tech it will really hit everyone in the face, just not VHC.

    It is sickening how they are really abusing the justice system, USTPO and fed Court Judges just to steal technology.

    I think you have a lot of research on your own to do to understand VirnetX, instead of nit picking at my article that is appreciated by the VHC community. I see you also have a never ending comment stream on other articles relating to VHC, specifically Dan Ravichers. I think you need to do more personal research.

    Hey sonic thoughts, looking at the patents virnetx has relating to the secure domain name imitative their method of establishing secure communications is unique. Moreover VirnetX has stated they have what the government is looking for, In a technology sense, to increase their level of cyber security.

    This was posted on virnetx'a website in 2010 hopefully this will answer some of your questions as all of the information regarding the topic is not publically available to me, only virnetx has their future plans and information.

    Scotts Valley, Calif., February 5, 2010– “The Cyber Security Research and Development Act passed today by the U.S. House of Representatives is long overdue because even one cyber attack against key infrastructures could paralyze the U.S. economy,” stated Dr. Victor Larson, Director of Research and Development for VirnetX Holding Corporation (NYSE Amex:VHC; CIA)-derived patented technology portfolio.
    Dr. Larson pointed out that recent research by the U.S. Cyber Consequences Unit (http://www.usccu.us), a non-profit research institute that assesses the economic impact of cyber attacks, stated that a single wave of cyber attacks on critical infrastructures could exceed $700 BILLION which is the equal of 50 hurricanes hitting America at one time.
    According to Dr. Larson, “The recent cyber attacks on Google, Inc. and other U.S. companies by hackers raises the need for securing the Internet with high-level security solutions that must include new sophisticated secure communications technology. These attacks are a wakeup call for companies because security issues with the Internet could cause loss of revenue. Even more important is that lack of security is a barrier to providing products and services over the Internet which can be an important market channel. Until security issues are solved the overall growth of Internet-based commerce and services could slow.”
    Larson also commented, “The real issue today is that the Internet infrastructure and the operating systems of the computers must be secured in new and fundamental ways. The present Internet was never designed with security in mind. Its overwhelming adoption for commerce and system control has attracted the criminal element. The Internet must morph into a network that has security at its core. This must be achieved seamlessly so that we transition into the next generation secure network without adversely impacting the Internet capability we currently have. The four players that will make this transition a reality are the Internet Service Providers (http://bit.ly/Ypp9QM), Cellular Phone Service Providers (http://bit.ly/11ERCtr), the operating system providers for every Internet attached device, and the Secure Domain Name System (SDNS) that seamlessly enables authenticated secure connections between all the devices on the network.”


    Also, VirnetX is going to charge for their secure domain services, an ongoing fee like a service charge plus an upfront payment to be in the registry. That is the most obvious way they can profit from this section of their technology. If there is anyrhing you can add, in a productive manner it would be appreciated.
