    Apple (AAPL -1.6%) and Samsung (SSNLF.PK) have been holding talks about settling the patent war between them. It appears that AAPL may be altering its stance somewhat, as CEO Tim Cook seems less enthusiastic about waging legal wars over patents than his predecessor, Steve Jobs.

  • Whereas Apple may have a considerable war chest to do legal battle, Samsung isn't exactly defenseless. Those who have experienced business litigation usually try and avoid a recurrence. Risks are considerable on both sides, including having parts or entire patents dismissed. One is never certain of a trial's outcome and not even Apple's lawyers would guarantee a favorable outcome. Jobs, for all his genus and talent, bordered on fanatical on this topic, willing to "wage nuclear war" over the issue. If Apple can negotiate a favorable agreement, then do it and get on with focusing on innovation and it's core business. A good negotiated settlement is better than a bad legal verdict.

  • Agreed if they actually compete. The devices being challenged are blatant copies of Apple's iPhone and iPad. If Samsung's own lawyers can't tell the difference between the Tab and the iPad then something is quite wrong (report below). Samsung has gotten more creating of late with their design. If that continues then all is well.

  • Design is an utterly stupid thing to have a patent for, amongst all of the stupid patents out there. The only difference between these and the Microsoft Tablet PCs that far out date it are that it's a flat front, all covered in glass. The shape is generally the same. Why? Because it's a shape that makes sense.

    If they all look the same then they end up competing on other things, like price, specs, experience and customer service. That's a win for all of us as people who buy these devices.

  • Well when Mr. Cook is sitting at a table to listen to Samsung chief we the bystanders could certainly wait ( but not hold breath) to see what happens. Mr. Job's complain was against parties that stole his intellectual properties, nothing else.
