Saturday, September 22, 2012, 9:09 PM ETApple (AAPL) wants Judge Koh to award another $707M in damages from Samsung (SSNLF.PK) on top of the $1.05B a San Jose jury awarded the company last month, as well as a permanent ban on 26 Samsung smartphones (it was previously looking for just 8) and 3 tablets come Dec. 6. Samsung wants a re-trial, alleging the time constraints of the California trial "prevented Samsung from presenting a full and fair case." Neither side will be giving its patent lawyers a break anytime soon.

All TVs are square, how come we didn't grant a monopoly to square TVs to the first company that come out with one? Maybe because back then we had some common sense. Now we are a dumb, stupid and pathetic country whose time is slowly passing by. This court case is just the latest example.

Apple is the dominate player in the smart phone area. No ever is heard saying, "I can't wait until the next Samsung product hits the market". To equate this request as weakness on Apple's part is just silly. Samsung isn't going away. But if they continue to steal product innovations from Apple, they will never be more then a second string player in the marketplace.
Apple is taking full advantage of it. Apple wins. We all lose since no one else is allowed to develop a device with rounded corners except Apple.
The patent D618677, 087, 305 and 889 are simply description of a device showing its shape, dimensions and what this device will be used as. Such information is required part of the patent process. No where within these four key documents did Apple claim to have invented "round corner rectangle". What Apple claim is the totality of these various elements that make up what an Apple device looks like and how they will apply this design toward an actual product.
Apple sued Samsung for infringing the "trade dress", a form of intellectual property that describes the characteristics of the visual appearance of a product or its packaging that signify the source of the product to consumers.
To put it in a lame "duck" terminology: If a duck has a patent on its "trade dress" and you took special care to make yourself look like a duck, quack like a duck, and walk like a duck, with the similar duck shape, color, dimension, and the "trademark" ugly beak, and as result, people gave you lots of duck food, then the jury would find you guilty of infringement on the duck's trade dress patent, and depending on how angry the duck is about your wilful intent to mimic him and the amount of duck food that you have received as a result, he may ask the judge for up to three times the damage.
Each one of them is copied by SamSung (and others).
and what did SamSung do instead of copying ? oh the 5'' screen on their phones .. but who can't do that ? as a matter of fact it's a lot harder to make up compact then size up. Oh, I know I left something out - Stylus!
This is absurd. These claims are absurd. How did we go 200+ years without any such lawsuits? Did it hurt innovation back then? On the contrary, not having to worry about infringing on someone's "trade dress" and other absurd legalese terms facilitated innovation. And now we have a plethora of these lawsuits.
Companies are spending more resources and money hiring lawyers to fight lawsuits than actually innovating.
I'm predicting that a bulk of the profit from Galaxy S3 will eventually go toward Apple, because the accusations is basically the same.

Pride cometh before the fall..... and tech is littered with carcasses of companies that were once the dominant forces in the world.
Foss Patents has more details. If successful, Apple would be able to completely block any and all Samsung smartphones and tablets from the U.S. market.

So what is your point exactly?
They don't believe in "property rights". These are the same people that copy songs and don't think the record company or artist deserves any money. These are the same people that think that electronic books should be for free. Software should be free.
At the end of the day, this is about "property rights" you either believe in them or you don't. They don't. Without property rights you might as well forget about capitalism.
I'm embarrassed that it's taken me this long to figure that out. When someone doesn't believe in property rights there really isn't any point drilling down to the details.
In copyright, I believe heavily, and practice judiciously. The problem I have in this case is the "design patent" which is a bastardization of the US patent code, not possible to duplicate in other countries.

Why is Braun not suing Apple over trade dress? Especially when Jonathon Ive has stated in public that Dieter Rams was an influence on his work.
Apple has every right to protect their patents.
