An appeals court has ruled that Motorola (GOOG) can't enforce a patent injunction stopping Microsoft (MSFT) from selling its Xbox 360 and certain Windows software in Germany. As Microsoft had sued Motorola for breach of contract in the U.S. prior to the latter's suit in Germany, U.S. courts have the authority to stay the German injunction.

  • More fun in the patent wars. If all these patents are really worth all they claim then Motorola and RIMM might have the most leverage.

  • Patent wars are one of the last things a company has when it can not innovate any further....sad.

  • In the mobile space they are all suing each other and at least some of them are innovators so in this case I think it is just strategic turf war as they know phones are just hardware and the prices will eventually go DOWN!!!

  • I understand the need for intellectual property but alot of the patents are marginal design types or software methods. So I get very wary if a company's ability to progress is protecting the radius of there devices' corners vs innovating a game changer piece of hardware or software.
