The USPTO has invalidated Apple's (AAPL) "rubber-banding" patent, citing prior art. The patent, which covers a software feature that indicates a user has scrolled to the end of a list, was successfully used in Apple's California win against Samsung (SSNLF.PK), as well as against Motorola Mobility in Germany. Apple can, and likely will, request the decision be reconsidered. Regardless, Google (GOOG) has already come up with a workaround for Android.

  • The strange thing is that this negative news did not drag down the stock at all, but the postive "main-event news" of new product introduction caused the 20 point plunge today.

Halloween is near, so stranger things can happen... like a earning surprise later this week.
