Interesting day. Judge Jackson by previously denying the MSJ and the defense of Laches lulled Plaintiff counsel into a false sense of security. Plaintiff was unprepared to deal with this effectively and Jackson offered no respite. Plaintiff took exception and was denied. This sets up a strong possibility for an appeal that VRingo Counsel will consider exploring at a later date based on outcome. Judge Jackson knew this and I'm sure this off guard move is centered around forcing a settlement. Its no mystery that not restarting trading after 3:10 pm EST was not in response to the Court decision as the stock adjusted 3 times during Circuit Breaker events to account for these Court changes. More than likely Google and Vringo are indeed trying to work out an equitable solution an I would expect to see that tomorrow.
