Thursday, December 27, 2012, 3:45 PM ETA federal judge has ruled in favor of the FDA and dismissed Mylan's (MYL -0.5%) suit against the agency relating to it's decision to withhold approval for the company to sell a generic version of Novartis' (NVS +0.4%) heart drug Diovan. The court said the FDA had not acted “capriciously” when it denied MYL exclusivity to market its version, furthermore, the company failed to show it suffered “irreparable harm” as a result,
