    The FDA won't appeal a decision to overturn the conviction of a salesmen who was found guilty of marketing narcolepsy drug Xyrem for treating drowsiness and chronic fatigue, two conditions for which the medicine wasn't approved. A court quashed the conviction because it said FDA regulations violated free speech in a decision that could have wide ramifications for the agency's ability to regulate off-label drug marketing.

    So this court is saying its okay to permit fraud as a matter of free-speech? As long as a private citizen can still sue this individual for committing this fraud I agree with this decision of the court - otherwise what a load of crap.

    This individual is selling a drug, since all drugs are approved by the FDA for treating some condition which they specify and this individual is lying about the conditions this drug can treat; His lie doesn't won't help the public in any way, I don't see how free speech is violated. LOADS OF CRAP.

    Good decision. Off label uses for drugs are used all the time, like Wellbutrin, an antidepressant, is prescribed to help people quit smoking. Leave the prescriptions to the Docs.
