  • CREE's KEY PATENT Has Been REEXAMINED BY PATENT OFFICE 0 comments

    Cree's key patent 6,600,175 licensed by Cree to other companies (Nichia, Toyoda Gosei, Osram, Koninklijke Philips, etc.) which generates royalty revenue for Cree and which has broad claims on white LED technology has been REEXAMINED by the patent office and given a FINAL REJECTION. The Examiner did very high quality work and rejected the patents claims on multiple redundant grounds. Cree has appealed the final rejection, to the Board of Patent Appeals and Interferences, but historically the BPAI has reversed the reexamination unit only 20% of the time.

    Anyone interested in the learning about the application of standards of patentability would be well served by reading the final rejection.

    The detailed legal arguments aside, it is common sense that down converting uv or blue LED light was not patentable in 1996, maybe in 1896 but not 1996.
