Investors May Be Able To Recover Tenant In Common (TIC) Losses

During the boom times, pre-2008, broker/dealers (see the extensive list below) sold billions of tenant-in-common investments (TICs) to retail investors nationwide. These investments, which were touted as having great tax and other benefits, have generated enormous losses and been the cause of financial devastation for many elderly and retired investors who believed their nest egg was safely invested.

Millions have been awarded to investors in FINRA arbitrations over the past few years. Recent awards include:

  • A San Diego couple who purchased two TIC investments from LPL Financial was awarded $1.4 million
  • Pacific West Securities was ordered to pay over two million to investors who purchased TSG Midwest, Evergreen Springs, Argus TriWest, Passco River Park and Passco Promenade
  • QA3 Financial Corp. was hit with a $1.6 million award for sale of a TIC investment to a couple in their 70's
  • CapWest Securities ordered to pay $338,000 for sale of Renaissance Meadowlands Hotel and the Arbors on Main Apartments TICs
  • CapWest Securities lost another case involving Water Song Apartments and Cabot Turfway Ridge Acquisition TICs. Award of $156,000.
  • Great Northern Financial (now defunct) lost a TIC case involving DBSI and was ordered to pay over $424,000.

Since the vast majority of FINRA cases are resolved, confidentially, generally on the eve of the arbitration hearing, no doubt broker dealers have paid out many millions more.
