A group of major retailers (TGT, M, TJX, KSS) file a new lawsuit against Visa (V -1%) and MasterCard (MA -1.2%) over the interchange fees the payment companies charge as a sweeping $7.25B negotiated settlement on the issue appears in danger of crumbling.

  • It doesn't really matter so much as they are only opting out of the monetary settlement; the non-monetary/injunctive part of the settlement is non-opt outable as it has already received preliminary approval by Judge Gleeson. It'll really be up to V or MA to decide whether to call off the deal if opt outs are below their 25% threshold. Since a result, since the ball is in V/MA's court, I'll be surprised if they call off this deal that has taken so hard/long to negotiate. So dont worry about it too much...
