Banner Pharmacaps tells Depomed (DEPO) it has filed an abbreviated NDA with the FDA to sell Anda, a generic version of the latter's Zipsor anti-inflammatory capsules. Banner says five patents listed for Zipsor either won't be infringed or they're unenforceable. Watson Labs (ACT) is involved, as it will commercialize Anda. Depomed "intends to vigorously enforce its intellectual property rights" and has around six weeks to start an IP lawuit against Banner that would automatically bar the FDA from approving Anda for up to 30 months.
