Will an aggressive DOJ take the shine off potential mergers?

  • If the Department of Justice is going to flex its anti-trust muscles on the US Airways and American Airlines merger could other high-profile deals - both rumored and in progress - be at risk?
  • Discounters: Dollar General (DG) and Family Dollar (FDO).
  • Satellite: DirecTV (DTV) and Dish Network (DISH).

If the Obama administration follows Bill Clinton, they want a weak DOJ that does not interfere with mergers. Mergers cause the markets to go up and result in capital gains taxes being paid. Clinton got that and rubber stamped the mergers in the mid 90s and watched the market go up. A too aggressive DOJ will dampen the market.
