Vringo resumes trading, shares +35.5% premarket


After coming off a halt, Vringo (VRNG) is blasting off in response to yesterday's court ruling, which assigned the company a 6.5% royalty on a "royalty base" of 20.9% of Google's AdWords search ad revenue (amounts to 1.36% of total AdWords revenue).

There's a good chance Google will appeal the ruling.

    The underlying judgment is already on appeal to the Federal Circuit. There is ongoing motion practice to consolidate post-judgment rulings into a single appeal to be considered by one merits panel:
    "Because of the interrelated nature of the issues being appealed in each action
    and the overlap in the underlying issues, to facilitate judicial efficiency and
    preserve Court resources, Defendants-Appellants respectfully ask that the Court
    designate Appeal Nos. 2013-1307, 2013-1313, and 14-1233 as companion cases
    and schedule oral argument before the same merits panel. "
    It is likely that Google, et al. will file a separate appeal of this ruling to be safe.

    Both sides are appealing but only the laches and jury error (both in VRNG favor should they be fixed), have any real shot of changing...Google wil be paying close to $1.4B through Q1 2016 with another $700M if laches is reinstated. $2b in the bank with 100M shares outstanding...you do the math
