Herbalife hires heavyweight lobbyist to counter Ackman

  • Herbalife (HLF +0.3%) appoints Alan L. Hoffman to the newly-created position of SVP of Global Corporate Affairs reporting to Chairman & CEO Michael Johnson effective August 25, 2014. He joins the firm from PepsiCo where he is SVP for Global Public Policy responsible for policy development and external/government relations.
  • Mr. Hoffman was formerly VP Joe Biden's Chief of Staff and President Obama's Deputy Assistant.
  • Separately, SVP of Global Corporate Communications Barbara Henderson retires. She will assist with the transition to Mr. Hoffman and remain President of the Herbalife Family Foundation.

    If anyone attacked your business or your wife and family, I'm pretty sure you would do whatever is necessary (and legal) to defend yourself! I know I would! If someone repeatedly attacks you with incendiary comments for the last 18+ months, spends $50 million to try and dig up dirt on you and "donates" millions to Senators, LULAC, state AGs and others, how would YOU respond?

     

    I'm thrilled HLF is really getting aggressive against Bill Ackman. It was hilarious to see this pretender crying *sniff* *sniff* during his latest attack. What a joke!! He put on quite an act but it's OVER for him! M.O.A.S.S. coming soon!!

    If the ethics of my company were being attacked, I'd make sure they were there before defending them. If Ackman's accusations were lies, he already would have been sued. I'm guessing there's a lot of truth in his statements.

    It's a necessary evil in the politics game. Speaking of evil, Ackman is probably going to have to hire some image advisers once this messy fight is over with.

     

    Meanwhile everything's back to normal, another daily modest gain for HLF when all major indices are in the red.

    If his attacks are wrong, then HLF could simply sue Ackman and make him retract his allegations...are they maybe afraid the courts would look into their retail sales (to outsiders) or lack thereof in more detail?

    Ackman has very deep pockets, so if HLF were to sue, it would be a knock down, drag out fight. Herbalife could potentially sue for Libel and Slander, but Ackman could easily argue that he is simply stating his opinion which is perfectly legal. Herbalife would also need to open its records for discovery, and even assuming that Herbalife's books were spotless, Ackman could easily find a way to spin what he finds in a negative manner. A lawsuit against Ackman at this stage would be a long expensive battle and would most likely drive the stock price down. It is better for HLF to wait for regulators to make their decision and then decide whether to pursue Ackman, afterall, if the FTC gives HLF a clean bill of health, winning a lawsuit against Ackman would be much easier.

     

    Hiring a PR /lobbyist is also expensive, but it can have a long term lasting positive impact on the HLF brand.

    I think Ackman will merely disappear. He will either lose or sell Pershing Square, like he did Gotham Partners. He has zero credibility and is burning up cash at a record pace. Say goodbye to Ackman.

    Actually at this stage it might be good and perfect timing. Ackman was wounded badly on Tuesday. Strike the iron while it is hot. Ackman has spent millions and is still losing millions almost daily. The buy-back was a near fatal blow, taking him to court and suing him would be the final straw that breaks the camels back. Ackman's back.

     

    Despite his arrogant reply to the hint of a lawsuit, "Bring it on!" Ackman does not want this but I hope HLF follows through and nails this turkey. He deserves it and there is not doubt that HLF will win and take Ackman for mega millions.

    Sorry Soxfan, I have checked HLF out very thoroughly. I see no truth in anything Ackman says and a lot of quality in HLF. If it wasn't a good company, I would not be long.

    With all that Ackman has claimed it's quite telling that HLF hasn't sued and continues to posture while they desparately try to lobby the gov't to look the other way. HLF knows better as they privately try to stave off any investigations while publicly feigning or buying legitimacy.

    The allegations from Ackman and the FTC are about whether or not HLF is an illegal pyramid scheme. Answer: HLF is one one the best legal MLM's on the planet. A company doesn't become highly successful by being dishonest for 5, 10, 20, 30 years!

    Seems like HLF hit a nerve with the shorts. Their allegations of HLF being a pyramid scheme, has changed to HLF should sue Ackman or why is HLF hiring such a heavy hitter as a PR person?
    Ladies and gentlemen, Ackman presentation destroyed the shorts - its over for Ackman! If you don't know - Ackman has been a wounded animal in self destruction mode for awhile. Tuesday presentation and foolish statements like "I've spent $50 million of research that will show HLF is a fraud and how HLF will collapse, only confirms his desperation. There was no reason to over hype and under deliver, was there? Only a wounded animal resorts to such desperate tactics.

     

    Ackman is wounded, bleeding and dieing on this foolish bet.

    I'll bet you don't mind Senator Markey and that raving liberal from Calif.. Congresswoman Linda Sanchez. Ackman contributed to their re election funds and they got this to the FTC. You have to fight fire with fire. Forget anybody outside.. Herbalife has a great CEO Michael O. Johnson. I've met a lot of people.. but he is cool and genuine. And he really loves this company.

    If Herbalife is such a great health food and cares to sell quality nutrition, it wouldn't use toxic soy. Any person that is into very healthy eating does NOT consume non organic, non-GMO and non fermented soy! Herbalife sells gmo non fermented soy.

    Actually Herbalife sells a NON GMO shake formula.. it is sku# 1213. We also have a kosher formula.. something for everyone. Oh and by the way.. I have been putting that 'toxic' soy formula in my body everyday for 31 years. I couldn't be any healthier!

    Herbalife went through much worse than this in the 1980s with the FTC, AGs, SEC, the FDA and more and here we are 30 years later and HLF still stands tall. Don't be spooked by those regulatory bodies. They are only doing their job and the truth is on HLFs side, not the bashers. And don't be too hard on the shorts either. Many shorted for the same reason we are long. They saw that side of the trade as ideal and surprise, surprise, many of the shorts, perhaps most of them don't like Ackman any more than the longs do.

    Ackman reminded me when crying in his presentation the scene in the movie Gladiator, where the emperor, played by Joaquin Phoenix, was left alone by his guards to fight face to face wiht Maximus. The emperor was a spoiled and coward child, who more than loosing his life in the movie, lost the respect and admiration of his people.

     

    I personally believe that Ackman did the Herbalife bet for recognition, people do more for recognition than for the money. This guy has it all, very successful at a Young age, brilliant as a financer, but nobody new who he was, outside of his small wallstreet bubble. Nowadays, he became the villian in a saga who has made him worldwide famous. Now he´s got the only thing that otherwise would have never accomplished, he did it under the shadow of a true global leader called Herbalife.

     

    Some may consider my opinión convoluted, but the question to be asked is, why does someone so brilliant made such a terrible mistake? For me the most reasonable answer: thirst for worlwide recognition.

    I think young people have a hard time understanding what's going on. It is conventional for an MLM to cultivate an air of exclusivity. There is nothing sinister about that. For example, your friendly Avon representative reminds you "this lip gloss is not available in stores." It's old hat you either buy or you don't.

    It's old hat? With HLF, we have internal documents outlining the targeting of those who are so poor and uneducated that they can't understand what's going on. When banks and cc issuers do this, it's predatory lending. When tobacco cos do it, they're merchants of death. When HLF does it... we'll see. They may very well escape, but not for the reason of being legit.

    This may surprise you to know this, but I have come into contact with many shorts who have an even lower regard for Ackman and his paid shills that the longs do. They feel that these guys are actually hurting them. So see some of us have come together.

     

    Shorts are not bad people and in most cases, they were at one time and will again go long.
