Under a 2009 settlement over the payment of out-of-network care, health insurers agreed to provide $95M for a new objective database of doctors' fees that patients and insurers could rely on. However, the insurers are not obligated to use it, so they use a calculation method based on Medicare rates that often significantly cuts the reimbursement.
