- Netlist (OTCQB:NLST +7.8%) states a federal appeals court (the CAFC) has denied a request by telecom/data center chipmaker Inphi (IPHI -2.5%) for a rehearing of a November opinion upholding patent claims related to LRDIMM server memory modules that were challenged by Inphi.
- To continue challenging the claims, Inphi now needs to take the case to the Supreme Court, which hears only a tiny % of appealed cases. Netlist: "With more than thirty U.S. and foreign patents broadly covering fundamental aspects of LRDIMM, this final decision by the Federal Circuit puts us in the strongest possible position to pursue licensing opportunities in the fast growing LRDIMM market."
- While Netlist rallies - shares soared when the November ruling was first disclosed - Inphi is following markets lower. The company's Q4 report is due on Feb. 4.
