The ITC dismisses bankrupt Eastman Kodak's (EKDKQ.PK) infringement suit against Apple (AAPL) and Research In Motion (RIMM), affirming the May decision of an administrative law judge. Kodak says it will appeal the ruling, which relates to an image-preview patent for digital cameras, to a U.S. federal court. The decision deals a blow to Kodak's efforts to fetch a huge selling price for its patent portfolio; the company is pursuing a separate case against Apple through a U.S. district court.

Onwards to endless appeals. Meanwhile the patent system still appears in need of cleaning up. Licensing revenue potential and impacts on margins are the reasons behind these battles, but so far it appears only the attorneys are really profiting.

Only the vultures will benefit from any Kodak patents. Corrupt management waited for bankruptcy to prevent shareholders from benefiting.

Any shareholders left in the stock over the last five years deserve what they had coming. Management has been incompetent at least til then, if not longer.

I don't know anything about the patents, but I do know the ITC is a political animal. I bet that they were biased against Kodak since it's not an ongoing concern, unlike Apple or RIMM. These kind of calculations definitely enter into their decisions. Another one is whether the party is US-based or foreign. Justice is not blind, for better or worse, at the ITC.

I can't understand why legal precident doesn't act as a boiler plate upon which further decisions are based. Something smells fishey to me...
