InterDigital (IDCC +14.6%) takes off after a U.S. federal appeals court rules (.pdf) in the company's favor in a long-running suit against Nokia (NOK +4.2%) related to InterDigital's 3G patents. By doing so, the court is reversing an ITC decision in Nokia's favor, and remanding the case for further review. Update: InterDigital has issued a PR praising the ruling, and stating it will again ask the ITC to ban Nokia products using the W-CDMA 3G interface (used by AT&T and T-Mobile).

    InterDigital Communications, LLC, and InterDigital
    Technology Corporation (collectively, “InterDigital”)
    appeal from an order of the International Trade Commission finding that InterDigital’s patents, U.S. Patent Nos.
    7,190,966 (“the ’966 patent”) and 7,286,847 (“the ’847
    patent”), were not infringed by Nokia Inc. and Nokia
    Corporation (collectively, “Nokia”). We hold that the
    Commission erred in construing certain critical claim
    terms in both patents. We therefore reverse the Commission’s order finding no infringement and remand this case
    to the Commission for further proceedings.

    Q If Nokia lose this case Luke or does any one else know what the liability of the claim will be in $

    They lost the appeal, they still have options. But if they do lose, they will have to pay up. Nokia had a license with InterDigital that expired in 2006, they couldn't reach a new agreement.

     

    In 2006 Nokia paid InterDigital $253 million, I am betting InterDigital is looking for a bit more this time around.

    So Nokia will owe 3g royalties from April 26 2006 up to the present date according to the above article if Nokia loses in the end.

    Nokia is just as big a patent troll lols. I am long Nokia, but if they lose they got to pay up.
