A Los Angeles court has thrown out, with prejudice, a case against Dole Foods (NYSE:DOLE) which was filed last year by nearly 3K Philippine plaintiffs claiming to be banana workers who had been injured from alleged exposure to the agricultural chemical DBCP more than 30 years ago. The Court noted that there was no scientific evidence to back the claim, and the suit should never have been filed in the first place. The plaintiffs had filed an identical lawsuit 13 years earlier in the Philippines, which was evenutally dismissed by the Philippine Supreme Court.
