Samsung (SSNLF.PK) might not even have laid its hands on the iPhone 5 yet but the South Korean company already intends to add the device to its patent lawsuits against Apple (AAPL). "Based on information currently available," Samsung reckons that the iPhone 5 will infringe its IP "in the same way as the other accused iPhone models."

  • Am I the only one who is starting to get annoyed with this upstart Asian copycat company. They mimic everybody elses products and then try and pretend they are innovative themselves. Jokers!

  • That upstart that you mentioned has been in existence since 1938. It is the largest industrial conglomerate or chaebol in Korea. The annual sales of this company in 2011 is around $250 billion. The market cap exceeds $100 billion. In no way can you call it an upstart.

Samsung is famous for being the so called "fast executioner". They are seldom the first one to be on the forefront but once they see an opportunity and they shall go in and improve on existing model. Go to a Best Buy and you can see what Samsung and LG do in the TV market to former pioneer like Sharp, Panasonic, Sanyo, etc.

On the other hand, while Samsung is neither new nor weak ( being bullied by Apple), I do believe that they don't have the culture to put forward a disrupting new product. If you take away the first Galaxy phone and tablet that they directly copied from Apple in 2008/9 and force them to design something on their own, I very much doubt that you will see the Galaxy S3 you see today. The S3 may still come but maybe a year or more later.

That is why I have little sympathy for Samsung. I accept people may love their S3 but let's not forget how Samsung stole the original design from Apple in 2008/9 and gained a foothold in the smartphone industry. Without that first step, their rate of development would be much further behind.

  • So Sammy is going to sue over a FRAND patent? I sure hope AAPL drops today so I can buy more calls.
This move by Samsung was easily predicted, and until the phone is out and has been deconstructed, has no legs.

  • I am biased. I got everything Apple even shares! SO listen to this Samsung crap make me cringe. 'Pot Kettle' I would say. Just pay the lawyers and move on to next case. Loser!

  • I was looking forward to buy a Samsung Galaxy S3, now I changed my mind and buy an iPhone 5. USA shed its blood defending South Korea during the Korean War, and that's how they act now?

  • I'm long Apple but what the heck is going on? Samsung suing Apple over IP patents but I found an article today saying Unwired has filed lawsuits against both Apple and Goggle over IP infringement. http://bit.ly/Ul3gQI

  • Interesting link. Patent issues can be terribly technical and hard for many investors to understand. Maybe that is why Buffet stays away. I think large tech behemoths like Google, Apple and Samsung are always going to have people jumping in front of their speeding cars claiming to get run over. I'm not speaking to the merits of these patent claims but I think a lot of squatting goes on in the patent world where someone identifies winners and winning companies and then tries to hold them up for money. I can't speak to the merits of Unwired's claims but if they are really the big innovator and leader in wireless arenas we would have known that by now.

I really appreciate articles and comments that can shed light on the more technical science/patent issues underlying stock performance.

  • Regarding the UPIP suit.... at first I was thinking that it's another frivolous suit by patent troll via a $2 stock, but UPIP shareholders include Soro Fund and Soro is known to have stir up macroeconomic havoc. Plus UPIP is up +12% so we may have to take it seriously.

  • Samsung is a bully! Suing someone? That's terrible.

I hope you can sense my sarcasm.

  • Samsung is so used to copying Apple that they even copy their lawsuits.

  • Samsung should manage its lawsuits brought by LG Electronic in the meantime (if it has any time left).
