Nokia (NOK) is reportedly hatching plans to sue HTC over the design of its Windows Phone 8X model, announced last week. "Nokia is preparing to get HTC 8X banned in various parts of the world from going on sale when it will launch in November," a source tells PC-Tablet.com. The 8X and 8S bear more than a slight resemblance to Nokia's Lumia 920 and 820, and they'll be running the same OS.

    When I saw those HTC phones I knew this was gonna happen. Those phones are almost identical to the L920.

    They do look almost identical though. In fact without seeing the HTC & Nokia logos I'd assume they were the same. If Nokia haven't applied for and got design trademarks across Europe & the US they've got a big problem.

    This is one of the problems with handing ownership of your platform/OS over to someone else... Commoditisation. Any cheap Chinese cloner can come along and copy everything you do.

     

    Samsung ironically have exactly the same problem.

    a lot of the commentary on the verge reckon this is just wild speculation and rumour.
    Furthermore, as far as I'm aware, if one actually holds both phones, they feel and look very different. much more than in photos - that's what people who have used both phones indicate anyway.

    If this rumor is true, it's going to be a huge story.

     

    Even though I support Nokia and I was surprised by the similarity between the Lumias and the 8X/8S, I wouldn't support the principle of this legal action. Unless there is a true technological patent that has been violated.

    Exactly. And some of the Apple's complaints were borderline.

     

    Anyway supporting two partners that are suing each others would be an unsustainable position for Microsoft.

    Uh, you might want to re-consider your statement "Unless there is a true technological patent that has been violated"...

     

    I've seen graphics where a smartphone has many, many thousand of patents covering every pico inch of the suckers. NOK does not have a history of being a patent bully -- so I suspect that they would not be taking action over a frivolous -- just looks like ours -- matter!

    I actually have a bit of a soft spot for HTC - Microsoft pretty much made them. (i.e. by giving them a massive contract to make the 'SPV' smartphone. Yes, a smartphone 5 years before Apple invented them from 2002)..
    these new phones are also very beautiful and I hope they sell. I am long NOK, but what this ecosytem needs is 2-3 vendors giving it life and making it huge. I have a feeling HTC are very committed to WP8 - maybe even more than android now (i base this on their historical affiliation with Microsoft, and knowing senior people in Microsoft who have always over many years spoken warmly of them)
    -- maybe there are some internal patent breaches - but i don't see how externally a copy could have been made? the WP8 Lumias have not even launched yet and the HTC phones would have been completed by sept5 when Nokia announced them. Maybe a case of corporate espionage??

    If you are not an Apple Bigot and I doubt that you aren't, than you are surely not for Nokia from an investor's viewpoint. If you are than you are an dumb investor for making that comment.

    Anyone who isn't blind can notice the remarkable resemblance between HTC WP8 phones and the Lumia series.

    Nokia won't sell the 920 through verizon, so this HTC is the only option, if you have Verizon. Not very smart for a company in Nokia's position, to put a monopoly on who sells their phones. I have owned Nokia stock for many years and stood behind them. I am very disappointed that I can't even buy their product, without breaking a Verizon contract!

    How do you know that the 920 won't be sold through Verizon? As far as I know, Nokia has not yet announced its carrier partners for the 920.

    pretty sure I've seen Verizon has a deal with Nokia to have the 920...I hope so. I wanted a 900 last spring ...we have a family plan with AT&T. What a fiasco staff knew nothing, released on Easter Sunday, no phones...finally got it off Amazon for half the price and lower contract cost.

    While I wouldn't know the validity of such an action I do feel
    there is an undercurrent of patent war backlash in the tech
    .world. Despite, or because of current rulings, a future of more
    amicable agreements and licensing protocols is a possibility.
    If a patent bubble were to burst it could have an impact on companies relying too heavily on a patent portfolio strategy.
    While Nokia should fight for what is rightfully theirs , in the end
    what we as investors can truly put our faith in is tangible product,
    something that you can touch and might even hurt a little if you dropped it on your foot.

    No, no, no. This isn't what Windows Phone 8 needs. Windows Phone needs as many offerings as possible in order to gain commercial success. A patent war will just drag things down and create a limited market.

    Personally, I find this as moronic as Apple's legal action regarding Rectangles with Round Corners... but hey, if Apple has a trillion dollars in cash and just won a billion more by acting like a patent troll, Nokia felt the need to try the same kind of joke.

     

    Looks like a bit of despair to me but since Nokia is currently losing money, it might gain some income with this attitude... or merely extra media exposure for the Lumia Range. (Who knows their true intentions? Certainly not me.)
