Vivus (VVUS -0.8%) says the class action lawsuit filed in November 2010 against the company and two of its officers, alleging securities fraud by failing to state certain claims, has been dismissed with prejudice. The court had dismissed the complaint earlier, but granted the plaintiff's leave to amend it. This time, the same judge has thrown out the complaint entirely, saying the allegations are without merit.
