Vringo (VRNG -36%) issues a PR confirming a ruling that (citing the doctrine of laches) prevents it from collecting damages from Google for activity prior to Sep. 15, 2011, the date of its lawsuit filing. Vringo adds Google's motions to dismiss Vringo's infringement claims were denied, and that closing arguments for the trial are expected to begin tomorrow. Shares were halted around 3:10PM ET today after a freefall.

  • supposedly Google will find a way around it and not have to pay them goping forward, just for the time since the suit was filed. $80-$100m.

  • Vringo has more to lose or gain from this trial than Google because of the smaller size of its company.

  • Interesting day. Judge Jackson by previously denying the MSJ and the defense of Laches lulled Plaintiff counsel into a false sense of security. Plaintiff was unprepared to deal with this effectively and Jackson offered no respite. Plaintiff took exception and was denied. This sets up a strong possibility for an appeal that VRingo Counsel will consider exploring at a later date based on outcome. Judge Jackson knew this and I'm sure this off guard move is centered around forcing a settlement. Its no mystery that not restarting trading after 3:10 pm EST was not in response to the Court decision as the stock adjusted 3 times during Circuit Breaker events to account for these Court changes. More than likely Google and Vringo are indeed trying to work out an equitable solution an I would expect to see that tomorrow.
