District Judge Denise Cote yesterday mostly denied a Merrill Lynch request to throw out a lawsuit from the FHFA which alleges that the BofA (BAC) unit made negligent misrepresentations and carried out fraud related to the mortgage bonds that it sold from 2005-2007. The claims that Merrill Lynch will have to face include for recession and punitive damages.
