BP's internal investigation of Deepwater Horizon didn't address possible systemic causes, a key component in safety management, according to an expert witness for plaintiffs suing the company. BP looked at the direct cause of the blowout on the drilling rig and the role of the equipment and crew on the rig, but did not look at decisions made by management leading up to the accident.

    BP's management record, especially "on-site," has repeatedly been shown to be incompetent and/or indifferent to safety. The repeated disasters at their now sold Texas Refinery offer just one set of examples of that behavior. I fear they're in for a lot more than a tongue lashing and minor fines in court.

    If "systemic causes" are brought to the case, and found to be a contributing, negligent factor to the disaster, it will open up a whole new direction in corporate liability, decision-making, protocols. Namely, executives will be no longer be held accountable just within their own company for bad decisions, but legally accountable for vague, and arbitrary definition of things like "corporate culture", over which they may have little, or no control. Lawyers will be lining up at the door...
