Washington state court denies Intuitive Surgical's (ISRG -0.2%) bid to have a lawsuit alleging "improper marketing" of its da Vinci surgical robot thrown out. Plaintiffs say the company did not provide adequate physician training while a company spokesperson says the decision "was not based on the merits of the case."

    ISRG has been marketing its robotic operating machine, called the Da Vinci, for many years in many domestic and foreigcn countries, and its sales and income are steadily increasing by a wide margin because its product has cleared all the legal and medical hurdles and beyond. What is wrong with those court people in the state of Washington?
