    • Gartner forecasts tech spending will be flat in 2016 at $3.41T. The read from the research company is the first forecast since the Brexit vote.
    • IT spending forecast by category: Data Center Systems +2.0% to $174.578B, Software +5.8% to $332.21B, Devices -5.3% to $627.24B, IT Services +3.7% to $897B, Communications Services -1.4% to $1.3808T.
    • "2016 marked the start of an amazing dichotomy. The pace of change in IT will never again be as slow as it is now, but global IT spending growth is best described as lackluster," says Gartner research VP John-David Lovelock.

    • "Politics is now a topic in every client discussion," say David Kostin and team, and the nature of today's electorate nearly assures a close race, even though prediction markets currently assign a high probability of a Clinton victory.
    • When uncertainty rises, consumer staples (NYSEARCA:XLP) typically outperforms, while tech (NYSEARCA:XLK) lags.
    • Getting down to names, with protectionism and tax policy two key areas of debate, buy those stocks with high U.S. sales and high effective tax rates, and avoid those with high foreign sales and low tax rates.

    • Digging through this week's 13F filings, Evercore ISI's Pankal Patel and team attempt to separate the holdings of hedge funds and other active managers.
    • What they found were that institutions (active managers) were most overweight Wells Fargo (NYSE:WFC), IBM, and Coca-Cola (NYSE:KO). Two new names on the overweight short-list: Level 3 Communications (NYSE:LVLT) and Zimmer Biomet (NYSE:ZBH).
    • Hedge funds, on the other hand, were most overweight Time Warner Cable (NYSE:TWC), Priceline (NASDAQ:PCLN), and Netflix (NASDAQ:NFLX). Hedge funds also added to holdings of AIG, Humana (NYSE:HUM), Alphabet (GOOG, GOOGL), and EMC during Q4.
    • Also of interest: While consumer discretionary stocks (NYSEARCA:XLY) continue to be the top over-weighted sector for hedge funds, they pulled back from those names considerably during the quarter, and added to tech (NYSEARCA:XLK) in a big way. They also added to their underweight in the consumer staples stocks (NYSEARCA:XLP).

    • Ahead of revisions to the Global Industry Classification Standard structure set to take effect next August in which real estate-related stocks will be broken out of the financial sector, State Street's (NYSE:STT) Real Estate Select Sector SPDR (NYSEARCA:XLRE) opens for trade alongside the FInancial Services Select Sector SPDR (NYSEARCA:XLFS). The Financial Select Sector SPDR (NYSEARCA:XLF) remains the same for those looking for exposure to the whole sector in just one ETF.
    • Concurrent with the launches, SSgA cuts the expense ratio for the entire Select Sector SPDR ETF suite to 0.14% from 0.15%.

    • Making a big ruckus in this morning's news is the European Court of Justice's ruling that deemed a 15-year-old data-sharing pact between the EU and U.S. invalid. The decision cannot be appealed.
    • "Legislation permitting...access on a generalized basis to the content of electronic communications must be regarded as compromising the essence of the fundamental right to respect for private life," Europe's highest court said in a statement.
    • The ruling has significant implications on how internet groups can operate in the 28-member bloc, and will likely force thousands of companies to overhaul their businesses to avoid breaking the law.
