We would need to know what the terms of the Mars financing deal are and compare that to the other deals to decide if it would trade below par. The old deals are underpriced and undercovenanted for today's market, so if the old deals are to get done they need to be reworked, i.e. pricing significantly increased and structure redone. The failure to file the amended agreement with the CRTC was not "innocuous" as the writer mentions. In fact, there are signs that it indicates disagreement on CRTC requirements among the different buyers. They may well use CRTC regulatory stubbornness as an excuse to exit the deal claiming they have used their "best efforts" and thereby owe no penalty. Drafting of requiredCRTC revisions would not have taken more than a few days maximum. The buyers' regulatory lawyers had one month. @Macke with the call on Apple as a weak consumer play:What many people like Macke don't seem to realize is that Apple is thinking way beyond the iPod at this point in their business plan. We can see this forward thinking embodied in the iPhone in addition to the continual upgrade of their computers.
There can be no doubt that the halo effect of iPod owners switching over the Mac computers has been a huge benefit for Apple's overall market share. (Which continues to far exceed the industry average). Besides, Apple is also in the software business and continues to push into new territories (i.e. video rentals and other multimedia projects like iTV).
Any company that is trying to compete with Apple at this point is, I think, well behind the game as they not only have to overcome iPod's domination of the market, these competitors also have to find a way to seize on Apple's momentum and figure out a way to transfer music player users to a larger array of more meaningful (and more profitable) products. These cookies may be laced with rat poison. I'm itching to put my 30% cash holdings into use, but the so called bankers might have another surprise for the small investor-we'll know soon. For now I'll go with junior gold, TRAMX and a couple of beaten down chinese stocks. Meanwhile I like to see a new watchdog agency created-made up of ex insiders turned whistle-blowers to keep an eye on the wall street con men. In my opinion that's the only thing that can raise small investor's confidence in the system. Also place a ban or major restrictions on professional level shorting (have you noticed how Bloomberg's pushing Proshare ultrashorts lately). Reply
