    Humana (HUM) and Aetna (AET) yesterday joined UnitedHealth (UNH) in saying that they would offer some Obamacare provisions regardless of whether the Supreme Court voids all or part of the Act, including free preventative care. However, WellPoint (WLP) and Cigna (CI) are holding back on any pledges until after the court rules. (previous)

    Cigna (CI) agrees to acquire American Financial Group's (AFG) supplemental health insurance group for ~$295M in cash. CI says the deal provides significant opportunities for growth; AFG expects an after-tax gain of $95M-$105M from the sale, which is expected to close in H2 2012.

    The DJIA pokes its head into the green after being down nearly 100 points earlier. The S&P 500 (-0.3%) and Nasdaq (-0.3%) remain slightly negative. Leading on the upside are the health insurers as analysts conclude it's bullish if the Obamacare mandate is struck down and bullish if it's upheld. Sweet!

    The market's interpreting the Supreme Court hearings over Obamacare as positive for insurers, which are getting a lift. Comments from Justices indicate they believe that if mandatory insurance is struck down, they may have to also void the rule requiring carriers to provide coverage to all.     Cigna (CI +0.1%) CEO David Cordani says that a Supreme Court ruling on the constitutionality of healthcare law won't stop market forces from dictating how people insure themselves in the U.S. He says that even if the high court overturns the 2010 law, marketplace innovation will evolve.

    Cowen's healthcare conference sparks renewed chatter that Cigna (CI -2.7%) could unload its pharmacy benefit manager business, a move it considered in 2009. J.P. Morgan analysts say a sale would be the “best possible outcome” for CI's earnings; they also don’t rule out CI following Aetna in outsourcing its operations given CI believes the service is important.

    Shares of managed-care companies rise as the government's late-Friday release of preliminary 2013 rates for Medicare Advantage plans look better than expected. Bernstein says the rate news is "solidly positive" and well above the highest Street expectations: Humana (HUM +1.5%), Cigna (CI +1.4%) and Wellpoint (WLP +1%).

    Cigna's (CI -3.9%) earnings fell 37% in Q4 amid acquisition-related charges and accounting changes, but the bigger weight on shares is the insurer's downward earnings guidance and rising use of medical services in the new year. Cigna expects 2012 EPS of $5-$5.40 vs. $5.68 consensus. Peers also are lower: AET -0.3%, CVH -1.2%, HUM -1.4%, UNH -1.4%, WLP -1.6%.
