    Jeremy Allaire? The same Allaire that brought the world Cold Fusion and purchased and pimped JRun? Two completely closed and proprietary systems? Took standards, HTML and the Java Servlet Specification, and bent them to his own closed systems to sell his mediocre product? He's quite the expert on openess!

    One problem, who is going to pay for the content of these programs ? Not Jeff, hell, he only got TiVo because of 3 month free subscription. Want to go back to 1967 when we only got about 4 channels but they were all free? Better yet, what something for free, turn off your TV and go to library and get a free book. Reply

    I share your sentiments!

    I also have to say that poor customer service is becoming the norm in America. Most of these agents are being paid only a few dollars above minimum wage (products of our wonderful public education system).

    What the FCC should do is set-up a new system that would require cable providers to give customers the choice for a la carte menu to chose from. They should also require that the big providers offer a minimum number of small/independent broadcasters at {their own set price}.

    I see a future where your TV offers you hundreds of thousands of channels and all you need to be a broadcaster is a computer and broadband connection. If broadcasts of individual channels were priced according to what the producers ask for, that would create the ideal environment for successful competition.

    I'd also like to see thousands of educational lectures and courses offered for free 24/7 without any box or subscription in every state. This should actually be mandated by the federal government considering our public educational institutions are becoming more akin to youth detention centers, especially in our deteriorating cities.

    I think this is just a stupid act. It is obvious the main reason for Klausner wanting to sue so many companies is for the money, following the steps on NTP and hopefully will be just as lucky in winning the case. However, Klausner stand point doesn't seem to be as strong as NTP's, therefore, the chances of Klausner winning is doubtful. Reply

    Interesting catch! I'm sure this will come up as this progresses. I wonder if it could even be used to invalidate Klausner's patent. That's always a risk when one pursues an infringment case. Reply

    The AT&T Intuity Audix Message Manager product ( now sold by Avaya or whoever bough them ) had this capability in 1995, predating the Klausner patent.

    Look up the two referenced patents - neither one of them applies. Both state, and I quote:

    "...These codes or numbers are decoded by means of the caller entering DTMF signals into the telephone which are recognized, recorded and processed by the [Telephone Answering Device]. ..."

    Since an iPhone doesn't require the caller to enter DTMF signals - it gets its information from callerID info - neither patent is applicable. Nice try, but bogus claim. I don't know what the specific claims were against the other companies that Klaussner rolled, but it since iPhones DO NOT rely on callers to enter DTMF signals, the Klaussner claim loses. As I read it, Klaussner claims to have invented a way to signal to the recipient of a voicemail message by sending DTMF tones as part of the message - which, by the way, seems like a non-patentably obvious bit of "inventing".

    Work with me on this... hmmm.... I have a recorder here, which can be used to save messages... these messages are in audio format.... they could be people saying words.... or they could be other sounds that were somehow meaningful.... like, oh, I dunno, maybe DTMF sounds. That's it! We could record DTMF sounds to pass messages, just as we could modulate our voices to say "words" that could leave messages, too! Patent that! Get me some lawyers!

    What rubbish.

    Oh wait! They don't even make products! They don't even have a website!!!

    What are they suing for and why did it take them until after the iPhone came out to realize they had something special???

    Interesting to see Marc Faber's prediction of a consumer slowdown. As I say in "Bearwatch":

    That may reduce the monthly trade deficit for a while, but won't turn it into a surplus. China's ultra-low wage costs, combined with what seems to be very loose enforcement of intellectual property rights, are still set to hollow out Western industrial production of all kinds, as James Kynge's book makes abundantly and frighteningly clear.

    It's all very well finding ways for individual investors to benefit, but if you haven't got spare money to invest, you can't back the winner in this unequal contest. Without some degree of prosperity, what real peace will our countries have? I'd like to see a credible national economic plan from our politicians.
