DuPont (DD) yesterday won a ruling that bars South Korea's Kolon Industries from making and selling a rival product to DuPont's Kevlar high-strength fiber for the next 20 years. The ban follows a verdict in September 2011 that awarded DuPont $919M after a jury found that Kolon stole trade secrets by hiring former DuPont staff. Kevlar is used in bulletproof vests and brake pads.

A coalition opposed to California's Proposition 37 has collected $25M from corporate backers including Monsanto (MON), DuPont (DD), PepsiCo (PEP) and Coca-Cola (KO), more than any other initiative. The legislation, if approved, would make California the first state to require labels on genetically engineered crops or processed foods that contain genetically engineered fruits or vegetables, such as corn, soybeans, sugar beets and Hawaiian papayas.

Monsanto's (MON) $1B win on Wednesday against rival DuPont (DD) may be vulnerable , according to patent lawyers familiar with the proceedings. The size of the verdict alone - the fourth largest in history - puts it at risk. Two of the three awards that exceeded that amount were thrown out on appeal, and the other was cut by almost two-thirds. Add to the mix that no commercial sales were actually made by DD, and there's precedent, and possibly even a good chance, they could win on appeal.

Monsanto (MON) +1.7% premarket after last night's verdict of $1B in damages against DuPont (DD) in the patent infringement dispute over its Roundup Ready herbicide technology. DD vows to overturn the verdict on appeal, saying “several fundamental errors... deprived the jury of important facts and arguments.” MON notes the finding of willful infringement could lead to a higher damage award.

Monsanto's (MON) claim that DuPont (DD) owes $1B for infringing a patent on Roundup Ready crops and a counterclaim the patent was obtained through deception will go to a jury after closing arguments today. “It would be a bigger loss for DuPont because of the implication that their GAT trait wasn’t successful," says an analyst who thinks DD’s argument won't succeed.
