DuPont (DD -8.9%) follows its ugly Q3 earnings assessment with a declaration that its infrastructure projects in China had "stalled." CEO Ellen Kullman tells analysts during the post-earnings conference call she had visited China two weeks ago and noted demand had been hit by uncertainty over upcoming leadership changes, though economic stimulus efforts were starting to bear fruit.

The slide in DuPont (DD -9%) shares wipes away all their 2012 gains following the weak Q3 earnings report. But DD says it remains on track to achieve its full-year 2012 productivity targets for both fixed costs and working capital, and it is "taking the necessary steps" to move long-term into higher growth, higher margin businesses such as agriculture, nutrition and biotech. Also: DOW -3.1%, MON -1.8%.

A federal appeals court has stayed an injunction against South Korea's Kolon Industries in a trade-secrets battle with DuPont (DD -1.3%). A federal judge last month barred Kolon from producing any para-aramid fibers for 20 years after the company lost a court fight over high-strength synthetic fibers used in products such as Kevlar body armor. The decision means that Kolon can continue selling its Heracron fiber products while it appeals.

DuPont (DD) yesterday won a ruling that bars South Korea's Kolon Industries from making and selling a rival product to DuPont's Kevlar high-strength fiber for the next 20 years. The ban follows a verdict in September 2011 that awarded DuPont $919M after a jury found that Kolon stole trade secrets by hiring former DuPont staff. Kevlar is used in bulletproof vests and brake pads.

A coalition opposed to California's Proposition 37 has collected $25M from corporate backers including Monsanto (MON), DuPont (DD), PepsiCo (PEP) and Coca-Cola (KO), more than any other initiative. The legislation, if approved, would make California the first state to require labels on genetically engineered crops or processed foods that contain genetically engineered fruits or vegetables, such as corn, soybeans, sugar beets and Hawaiian papayas.
