- Wednesday, July 11, 2012, 1:14 PM Kodak (EKDKQ.PK) files an emergence performance plan with a bankruptcy court in New York that spells out potential compensation for its management team. At last look, the company had $574M in cash and was showing close to a $20M per month loss, although it has been cleared to sell patents and start the process of paying off creditors. 6 Comments [Consumer]
- Tuesday, July 3, 2012, 1:57 AM A U.S. bankruptcy judge clears Eastman Kodak (EKDKQ.PK) to auction its digital imaging patents as part of its restructuring; Kodak expects to move forward with the auction in early August. Apple (AAPL) and privately-held FlashPoint Technology had objected to the sale, both claiming they had ownership in some of the 1,100+ patents. Comment! [Tech]
- Friday, June 22, 2012, 10:59 AM Apple (AAPL) continues to try to buy time in its patent dispute with Eastman Kodak (EKDKQ.PK). On Thursday, the company asked a judge to have bankrupt Kodak's patent infringement suit reviewed by a jury in a federal district court, rather than by a judge in a federal bankruptcy court. That, in turn, could derail Kodak's plans to auction its patent portfolio in early August. Kodak, which received an unfavorable ITC ruling in May, recently sued Apple for attempting to interfere with its patent sale. 3 Comments [Tech]
- Tuesday, June 19, 2012, 10:02 AM Kodak (EKDKQ.PK) files a lawsuit in bankruptcy court against Apple saying the company interfered with its plans to sell its patent portfolio. The company alleges Apple is using its cash hoard to strategically delay royalty payments and hold up a sale of Kodak assets. (Previous: Kodak struggles to find patent portfolio buyer) 2 Comments [Consumer, Tech]
- Sunday, June 10, 2012, 2:54 AM Eastman Kodak (EKDKQ.PK) has been unable to attract an all-important stalking-horse bidder for its portfolio of digital-camera patents, the WSJ reports. The sale is crucial to the firm emerging from bankruptcy, but its cause has been damaged by a recent ITC ruling that an image-preview patent, one of the most important, is invalid. Comment! [Tech, Consumer]
- Monday, May 21, 2012, 4:26 PM An ITC administrative law judge rules against Eastman Kodak (EKDKQ.PK) in its patent infringement suit against Apple (AAPL) and Research in Motion (RIMM). The ruling (.pdf), subject to review by the commission, declares Apple and RIM to be infringing only one claim within Kodak's image-preview patent, and calls that claim invalid due to "obviousness." (previous) 3 Comments [Tech]
- Friday, May 18, 2012, 4:17 PM Eastman Kodak (EKDKQ.PK) accuses Apple (AAPL) of trying to undermine the sale of its patent portfolio in order to avoid paying $1B in royalties Kodak deems Apple to owe for its infringement (subject to a pending ITC ruling) of a patent covering a digital camera's ability to preview images. Apple is accusing Kodak of misappropriating technology the companies collaborated on; Kodak believes Apple's move is a stalling tactic. (previous) 2 Comments [Tech]
- Tuesday, May 15, 2012, 10:31 AM Bankrupt Eastman Kodak (EKDKQ.PK) is seeking expressions of interest for its patent portfolio ahead of a sale that some think could fetch over $2B. Major tech companies are expected to be among the bidders. However, the final price could depend heavily on the outcome of Kodak's ITC complaints against Apple (AAPL) and Research In Motion (RIMM); a ruling is due on May 21. 7 Comments [Tech]
- Wednesday, April 25, 2012, 2:30 PM Shutterfly (SFLY +4.9%) outperforms after announcing there were no competing offers to its $23.8M bid to buy Kodak Gallery from bankrupt Eastman Kodak (EKDKQ.PK). Kodak Gallery has 75M users, and stands to both strengthen Shutterfly's position in the online photo printing market, and expand its presence in the only photo gallery space, as fears grow about a decline in photo printing. Comment! [Tech, On the Move, M&A]
- Sunday, April 8, 2012, 4:26 AM Eastman Kodak wants approval (EKDKQ.PK) to pay $13.5M in bonuses to ~300 execs and other staff who have the knowledge and skills vital to helping the firm survive Chapter 11 and would be hard to replace if they left. Kodak has also withdrawn a request to end supplemental health care benefits for ~16K retirees. Comment!
- Thursday, March 8, 2012, 3:37 PM Apple (AAPL) is told it cannot pursue its patent infringement lawsuit against Kodak (EKDKQ.PK) for now, and is ordered not to file similar new litigation. The bankruptcy judge overseeing Kodak's case says it would be an "inappropriate way forward" to allow Apple to continue pursuing litigation over a Kodak patent that lets consumers preview digital photographs on LCD screens. Comment! [Tech]
- Friday, March 2, 2012, 8:17 AM Shutterfly (SFLY) +14.5% premarket after acquiring Kodak's (EKDKQ.PK) Gallery online photo business. Jefferies reiterates its Buy rating and $30 price target on SFLY, saying "the deal should solidify the company's position further as the leader in online print, and present a number of opportunities for revenue and cost synergies over time." Comment! [Tech, On the Move]
- Thursday, March 1, 2012, 6:32 PM Bankrupt Eastman Kodak (EKDKQ.PK) agrees to sell its online photo services to Shutterfly (SFLY) for $23.8M. Accounts of Kodak Gallery’s 75M users in the U.S. and Canada would be transferred to SFLY under the agreement, which is subject to competing bids at an auction. SFLY +17.6% AH. Comment! [Tech, On the Move]
- Thursday, February 16, 2012, 10:42 AM Eastman Kodak (EKDKQ.PK) has won court approval to borrow $950M to carry out its post-bankruptcy restructuring plan. In addition, a judge has ruled the company can end a sponsorship agreement for the theater that hosts the Academy Awards. (yesterday) Comment! [Tech]
- Wednesday, February 15, 2012, 12:44 PM Apple (AAPL) pushes to move forward with patent infringement litigation Kodak's (EKDKQ.PK) Chapter 11 bankruptcy halted, fearing that a disputed patent may be put up for sale as part of Kodak's restructuring. Apple says Kodak "misappropriated Apple's technology" to get the patent, which concerns a digital camera that can preview images on an LCD screen. Comment! [Tech]
- Thursday, February 9, 2012, 9:07 AM Eastman Kodak (EKDKQ.PK) says it will take a $30M charge to exit the digital camera, pocket video camera, and digital picture frame business in H1. The former Dow 30 company plans to refocus on licensing out its brand and scoring revenue from online and retail-based photo printing. 1 Comment [Tech]
