    Another tidbit from Green Mountain Coffee Roasters' FQ3 report: Legal expenses tied to a SEC inquiry increased to $2.996M, from $0.8M a year ago and only $0.7M just last quarter. Though the company has been answering questions posed by the SEC over the impact of its patent losses recently, the unknown depths of the government's probe remains an overhang on shares. Single-serve pack sales up 153% Y/Y to $638M, with a 28% percentage point gain in sales volume. Gross margin fell to 34.9%, from 36.8% a year ago. Though investors assuredly have their hard hats on after GMCR's FQ2 report led to a 40% freefall in share price, the company has already lowered the bar quite a bit this time around with its own guidance. One disturbing note heading into the report: Perma-GMCR bull Janney quietly lowered its estimate for the quarter.

Baird is downgrading Starbucks to Neutral, but Deutsche thinks accelerating unit growth, ongoing same-store sales growth, and lower commodity prices spell a buying opportunity. GMCR -1.3%.     Green Mountain Coffee (GMCR) -3% AH in response to Starbucks' (SBUX) weak FQ3 report and guidance. During its earnings call, Starbucks claimed it has shipped over 350M K-Cups since November, and now has a 20% share of the single-cup coffee market. However, it also said margins for the division responsible for K-Cups have fallen due to higher commodity costs.

While the company maintains the analysis is "wrong," pestering accounting questions have lingered on for about a year ever ever since the Grumpy Old Accountants blog gave the firm two resoundingly thumbs down for its financial reporting.
