    Citing a shift in tax revenue from FQ2 (ended in January) to FQ3 on account of the late passage of fiscal cliff legislation and the IRS' delayed opening of e-file, Intuit (INTU) says it expects to report FQ2 revenue of $960M-$965M, below a $1.03B consensus, on Feb. 21. However, the company's FY13 guidance remains unchanged. Shares have barely moved AH. (PR)

    Intuit (INTU) has acquired the assets of Payvment, a startup offering e-commerce infrastructure and ad-buying services to ~200K merchants relying on Facebook (FB). Payvment's customers have been transferred to rival Ecwid. Payvment's failure is raising fresh questions about Facebook's own ability to profit from e-commerce referral traffic. Though its Gifts product has seen some early uptake, skeptics argue Facebook's news feed (unlike Google searches) doesn't lend itself well to driving e-commerce activity.

    Judge Lucy Koh yesterday ordered Tim Cook to testify in a lawsuit over whether Apple (AAPL), Google (GOOG) and other hi-tech companies breached antitrust laws by agreeing not to try to poach each others' employees. Erich Schmidt is also due to appear in the trial, as is Intel's (INTC) Paul Otellini. Lawyers for the five plaintiffs in the case reckon that damages could reach hundreds of millions of dollars.

    The DOJ has filed an antitrust suit against eBay (EBAY) over an alleged agreement with Intuit (INTU) not to recruit the other company's employees, and for eBay to refrain from hiring Intuit employees at all. Intuit isn't a defendant in the suit. Non-poaching agreements have long been a controversial matter in the tech world.

    Tech guidance roundup: 1) Intuit (INTU) reiterates guidance for FY12 revenue of $4.55B-$4.65B and EPS of $3.32 -$3.38, in-line with a consensus of $4.59B and $3.36. 2) Applied Materials (AMAT)  expects FQ1 sales to be flat to -15% Q/Q, worse than a consensus for an 8% increase. 3) Autodesk (ADSK) expects FQ4 revenue of $570M-$600M and EPS of $0.43-$0.51, below a consensus of $604M and $0.54.     Intuit (INTU) reaffirms its outlook for FQ1 and FY13 at its investor festivities in California. The company's projected revenue growth of 10%-12% for the fiscal year is led by a strong outlook for its Small Business Group with new cloud and mobile channels contributing. (webcast)

    Intuit (INTU) is opening up the APIs for the financial data service powering its Quicken, QuickBooks, Mint.com, and FinanceWorks apps. By doing so, Intuit hopes to gain a leg up on startups such as Yodlee, which are trying to challenge the company's dominance of the personal finance software/services market (PR)
