A negotiated truce - which may be announced sometime this week - could include the retailer scrapping its 10-year deal with Martha Stewart Living Omnimedia and put an end to the trial raging in NYC. 2 Comments [Consumer]

Penney (JCP) hasn't disclosed if new CEO Myron Ullman is a permanent hire or a temporary replacement to Ron Johnson, but either way quick decisions will need to be made. The retailer needs a strong contingency plan in case it loses the Martha Stewart trial and morale from the executive suites to store floors needs to be refreshed. Another option that's been floated is to incorporate some of JCP's properties into a REIT. Penney (JCP +2.2%) with accusations leveled at JCP that it's selling products on its website in breach of an agreement to stop showcasing certain categories. The judge in the case will rule on the issue tomorrow. The bigger issue: J.C. Penney needs a win or a settlement in the case to avoid losses on inventory and a gaping hole in the retailer's line of home goods. 4 Comments [Consumer]

Penney (JCP) loses its courtroom battle to sell Martha Stewart home goods inside of its stores, the retailer will reportedly look to Asian suppliers to produce an emergency line of private label bath products, bed linens and kitchenware to fill the void. - Friday, April 5, 2:04 PM J.C. Penney (JCP +3.5%) CEO Ron Johnson "deserves criticism", according to Bill Ackman, who has been an outspoken fan of the embattled CEO until now. Ackman's Pershing Square Capital has lost ~$500M on paper from its investment in JCP thus far.
